Look, the patent Microsoft had for in-game music was only through its own Xbox dashboard. Meaning, its patent actually only applies to in-game music being played from the HDD through the dashboard.
Now, heres the loophole. Super Stardust HD has done it long ago, in-game music was provided through the game itself. Nothing to do with PS3's XMB. Granted that you cannot switch music anytime you want as you can with the 360, its still better than nothing.
There are other ways around where Sony should be able to do something about the patent.

a very very n00b question: if i want to download the update from the web, and update using thumbdrive, i should download the update according to my PS3 machine region right? if SG set, so i download from asia region update?
