rape is constituted as sex without consent.

and no he has no right to get sex if his wife doesn't want it. he doesn't own her.

i think msian laws dont protect wifes... there's no law to prosecute husband rapist... especially with shariah laws..

make it easy.... if wife dun wan... dun force... later kena jailed... so.. if she dun wan go out side and search for 2nd wife... easy.. no need to get sued for some silly wife. If you dun wan to have someone tied u up ... then look for hooker.. pay and done..

in malaysia, it is not consider as rape if the husband had sexual intercourse with his wife, married by a valid marriage(valid marriage means according to law la). (this statment falls under M'sian Penal Code section 375, exception, try to search for it, and u will see ), which means tat if against her will, it will also be not amount to rape !!! because it is valid under Penal Code!!

but if the husband causes hurt or fear of death or hurt to his wife, in order to have sexual intercourse, he may be imprisonment for a term which may extend to five years.( Penal code section 375A , recently amended) look carefully into the section, it does not even stated that under section 375A, it is rape, it just stated that the husband may be imprisonment.
therefore, in malaysia context, there is no such thing as MARITAL RAPE

Added on September 18, 2008, 4:51 amas for rape by wife or be generally by woman. it is impossible to be done, according to Penal Code.
it is because, section 375 define rape as: a man has sexual intercourse with a woman without her consent, against her will ..... and etc ( can refer urself) take note: a man has sexual intercourse with a woman, NOT a person forcing another person to have sexual intercourse!! it stated specific the gender, male but not male or female!!!

which means tat, under Malaysia context , only men can rape a woman, woman can not rape man. even if there is really a case which a woman rape a man, the woman will not be prosecuted for rape because lack of authority !!!!

Usually when a man want to have sex with his wife but wife don't let. It shouldn't harm the dude... after all its just 1 day =)?

But if the man is desperate for sex, I think there is always external factor causing it like work stress, etc, etc. I read about it in Reader Digest where a man want to have sex with her wife to feel "control" and a "winner" because at his workplace, he is receiving a lot of stress by his boss, etc. After a while his wife feel there's no love and doesn't want to have any intercourse with him which cause him to depress. (Wife please understand that when man want and no get, he get depress like a 4 years old kid. So at least reassure him or hint him that its just not today, you will his mood very differently)

Husband & wife cannot classified as rape even forcing...but its applicable if involve violence act....
Gf & bf can classified as rape when forcing occurs...
