in malaysia, it is not consider as rape if the husband had sexual intercourse with his wife, married by a valid marriage(valid marriage means according to law la). (this statment falls under M'sian Penal Code section 375, exception, try to search for it, and u will see ), which means tat if against her will, it will also be not amount to rape !!! because it is valid under Penal Code!!

but if the husband causes hurt or fear of death or hurt to his wife, in order to have sexual intercourse, he may be imprisonment for a term which may extend to five years.( Penal code section 375A , recently amended) look carefully into the section, it does not even stated that under section 375A, it is rape, it just stated that the husband may be imprisonment.
therefore, in malaysia context, there is no such thing as MARITAL RAPE

Added on September 18, 2008, 4:51 amas for rape by wife or be generally by woman. it is impossible to be done, according to Penal Code.
it is because, section 375 define rape as: a man has sexual intercourse with a woman without her consent, against her will ..... and etc ( can refer urself) take note: a man has sexual intercourse with a woman, NOT a person forcing another person to have sexual intercourse!! it stated specific the gender, male but not male or female!!!

which means tat, under Malaysia context , only men can rape a woman, woman can not rape man. even if there is really a case which a woman rape a man, the woman will not be prosecuted for rape because lack of authority !!!!
