Speak to owner, ask. Management to force owner to terminate their contract when the time comes.

If u r renting and upstair is owner, den u hv to move out.
He stays there, u can't ask. Him to move.

U must be living in 20 to 30 yrs old building.

Get a lawyer to settle it. U have the right to have peace of time in your living area.

When confronted, they blame the other neighbors (which is funny because I am on good terms with those other neighbors). How do I know it's not other people? I've been observing them and on the days they're home, they will purposely make noise and drop things at night in certain locations like my bedroom. When they're gone, it's blissfully peaceful.

Best to confront your neighbors with management if you really want to solve the problem.

Management doesn't have the right to force this on the owner. If they did, a lot of noise issues would've been resolved.

Even lawyers are hesitant when taking up these cases as the noise source can be argued to have originated from elsewhere.

Actually, the TS can make a police report with the evidence he's gathered. He can also scare them by getting a lawyer to issue a demand of notice and perhaps sue them, if they still refuse to behave.

They can't block the access card either, as long as they're still paying their maintenance fees. Even if they don't pay, I think management doesn't have the right to block a person's access to their home. Hence, collection of maintenance fees are never 100% at any project, whether low cost or high end.

If they're continuing with renovation works after the allocated hours, then management may be able to turn off the water/power supply temporarily.

You can call the police and even if they continue making noise with the police present, they can't do much either as it's deemed an occurrence in a private property.

You need to know the laws in this country are very lacking to tackle noise issues. Some management will have their own set of house rules where residents have to acknowledge upon moving in which clearly states you're not allowed to disturb the peace of another home, every tenant has equal rights to peaceful living conditions, etc. If so, you may consider engaging a lawyer to see if this will hold up in court.

Having said this, you will need to ensure you've done plenty of homework and collected a shitload of evidence to backup your claims. And these evidence need to be able to stick. Else it becomes a he said she said type of scenario and you'll find your case thrown out very quickly and you're left with a nice bill from your lawyer. Unless you have only one upstairs neighbour, this is one very steep hill to climb.

If you have very high iq and eq, try to irritate the person disturbing you into throwing a punch. Once you've eaten that punch, the police can then make an arrest.

So taking all the above into consideration, unless you have plenty of time to burn, the "solutions" aren't for everyone. If you have a stressful job, be prepared to have more stress added to your everyday life for all the extra work you have to put in. Make sure you have deep pockets to if you want to go the legal way, just in case.
