non compoundable saman means you can't choose to pay. your only option is to go to court.
so whether you sign or not means nothing. this is a one way saman.

Dont side with anyone, usually this kind of case many hidden setori.

If you feel police wrote a wrong summon to you, no need to fight with said police. You only will escalate the issue.

Just smile say thank you and fight in court. You have better chance if you caught him off guard.

If you mati mati fight on the spot, not only he still give u the summon, now he have time to kaw tim everyone to make sure his side of the setori is solid in court.

Thank you for your explanation. Initially I was under the impression that the police indeed did have evidence on their hand, as such they chose to issue a non-compoundable summon instead. Since the insurance agent now has evidence from her phone log, I wonder what will the police bring to court ?

Read the news article - she has proof from phone company records and also dashcam that points inside the car to prove she was not using the phone - police got what? I don't think police have telephoto lens camera to take photo of her.

The dashcam was only bought after this incident in case she kena again.

There is one time while my head was resting on my hand while the elbow is on the window. Terus Kena stop( police block), and need to explain to the police the spy mistakenly thought I was on phone, and need to show my history call (no call) baru boleh lepas.

Isnt it easier to just share the video and then everything can be settle.

Nothing usually. The polis might not even go to court, and you win by default. Which happens more often than you think.

However, the polis has the last laugh. He just spend 5 mins issue saman. You spend lawyer fees and time off to go to court. Worse if the case drags on a few hearings. You end up paying 5k instead of rm300.

But if you want to make a statement, go ahead. The polis who issue you saman won't feel a thing.

Unless of course like this lady, she go make noise until reach newspaper, maybe the polis will gabrah a bit. But you need to have a passion to piss the polis off. Otherwise, next time just pay the rm300. Consider it your unlucky day.
