Let him sue. Then later all the copyright holders will make even more claims against the YouTube channel. Chat This Famous Youtuber use my art without permission, now his fanbase harassing me

when youtuber infringe people copyrights, its up to copyright holder to give takedown warning or straightaway do copyright strike, its all up to his or her 'budi bicara', s/he's not obligated to be nice to copyright offender by giving them a warning first.
doesnt matter either whether youtuber offending copyright by honest mistake or deliberately. like other cases, you mistakenly broke someone property, you pay the damage. simple. ----- but about fan-art being illegal or not, i've no idea. QUOTE(Liamness @ Sep 21 2020, 02:29 PM) welcome to the new world. Fuck bro not sure if you serious or joking. You're a fellow professional as well right? email used to be faster than slow mail. so, it's only natural that things progress and technology is already there for instant notifications and messaging. No one uses twitter for official communication. And if you work in any big firm you would know the reasons why. Dont be a stupid unker trying to understand technology |

QUOTE(BlackMambo @ Sep 21 2020, 01:42 PM) Holy fucking cunt. Coming from someone who started the rambling and giving their own analogy it’s funny how suddenly you just wanna focus on real substantial arguments. Guess you’re really one of those snowflakes who thinks if I do it it’s ok but it’s not ok for others to do it. Calm ur entitled tits aite.Lets get rid of all the shitty analogy, rambling, strawman and focus on your real, substantial argument here. Yes, a youtuber is responsible for their own content. This youtuber is a rude fella, a cunt, for not crediting TS of said artwork. I agree with ya on this. But that still doesn't give TS any legal ground for a copy right claim. Like, at all. Not legally, not morally. Especially given how little effort TS did to reach out to this youtuber for any discussion or understanding. You honestly undermined how severe a copy strike, with zero context on the consequences and legal ramification behind it. How many 'screwups' or 'oopsie' did you do that would lead you getting fired without any income? How severe it is? Educate yourself a bit on this, ease on the rambling and come back with a better argument. On the legal ramifications, if the AMDK has any grounds to sue TS he would have done it already. The reason he went and posted a video to scare TS and get his followers to bully him is because the YouTuber himself also knows he doesn’t have any grounds to sue TS. Vice versa TS doesn’t have any grounds to claim his artwork. End of the day both of them got no grounds for shit. Plus now with the video he posted and with his followers harassing TS. TS can easily get the guy banned for good for bullying like what happened to leafy. How many screwups or oopsie does it take to lose your income? Depending on the situation even one is enough. If you breach something written in your contract for example, that one oopsie is enough. Now when YouTubers signed up with YouTube they agreed to YouTube’s terms and conditions. It’s the same thing. Now even if the first instance the TS did not have the right to claim copyright, the reaction from the YouTuber to create a video about it to bully TS is clearly against YouTube’s terms and conditions. So he’s digging a bigger hole for himself, guess he’s gonna play victim also if YouTube bans him for bullying/harassment. |

Did TS monetize this art piece ?
fan art is infringement of the original content and listed under fair usage. |

So the ball is in TS court now. |

QUOTE(C-Fu @ Sep 21 2020, 01:48 PM) why should he? the youtuber's action - that counts as a willing intent. he knew what he was doing. he did not ask permission beforehand. art is art, and often got idiots who think stealing art should have some "fair use" leeway, even when fair use means something else entirely. personally i just don't think it's worth the hassle, maybe time and money as well if escalatea local telco stole my work many many years ago. somebody there think it's OK because it's just me vs her hiding in the name of the telco. think she wanna layan my request that 1. she willingly stole my work 2. she did not ask permission 3. she should have paid me 4. she have to pay me and MY SIDE have to wait for the whole redtape communication in the telco crossing multiple departments and levels and floors for a youtube video, and suck it up and expect not to have a favorable outcome in the meantime? yeah. no fucking way. ako dmca je. instant communication, she got reprimanded as she should, telco apologized. fast, easy, setel. fuck that white boi privilege. he knew what he was doing, he did not ask, nor did he want to ask beforehand, and now whining about a bigger entity enforcing dmca before that entity kena enforced themselves, and now trying to gain sympathy to join the group that got assraped by dmca? go die la cb amdk if can solve it peacefully that's the best now he say cannot sleep cannot eat |

QUOTE(C-Fu @ Sep 21 2020, 02:27 PM) to talk about legal basis, we need to understand what legal basis means. Pfft, do you even know what derivative law is.but to answer, yes he does. in fact, if YOU want to copyright strike that jewtuber, go ahead, as even YOU have the legal basis. but youtube nak accept or not lain cerita la. you don't get it. watch that video you yourself put again. no such law that says fan art is illegal. that's stupid. lawmakers aren't stupid. it's not one of those things that benefit from being vague. but got commonwealth as well as US laws that says about creating derivative work, about SELLING derivative work, about DISTRIBUTING derivative work. if i really wanna entertain you, I'd ask you about what law says about derivative work as a DEFINITION. again, cakap biar clear la dik. unless nak melebat dalam forum je la. Under US law derivative work only applicable to preexisting work in its actual form. A modification or an alteration from THE original art form itself. Eg, altering Godfather movie scrip, altering the color of Van Goh original art. The main key factor is the the COPYRIGHT ONLY EXTEND TO THE ALTERED PART. Anybody with a lick of sense would know that this law does not applicable to an INTELLECTUAL PROPERTY RIGHTS. |

QUOTE(nakal_mode @ Sep 21 2020, 02:39 PM) Again, understand how the Youtube copyright system work before saying anything. I already said both of them got no case, plus Thequartering was the one who said he will file a court case. TS didn’t. So now TS copyright strike, he dispute it, I don’t think TS should raise a court case for the copyright. If TS smart he can just report the new video for bullying and harassment and get that fella banned. It is up to TS to file a court case not TheQuartering, TS copyright strike him, he dispute it and the next step is for TS to take it further and file a court case or he can choose to release the claim.
