Q&A Is it possible to be fired for no reason?

Last week I lost my job.
Company requested I leave immediately on the evening itself. Just wondering, is this normal? Any law involved that say I should be compensated?
Worked there for 3 years.

If no, and they didn't give any notice, you can bring this matter to the industrial court under unlawful dismissal (assuming your salary is above 4k?)

Happened to me few years ago.

My ex-boss chose to relay the news to me and asked me to leave citing bad business as the reason.

and he chose a very good time to tell me , just 1 week before CNY.

that was the worst ever year ,and lowest point financially in my life.

There was no warning letter.
To be honest company wasn't in a good financial situation. Last week boss notified and said this is really the final straw.
Company offered compensation of 1 month salary.
My salary is about RM4.5K. I haven't signed the compensation notice yet.

I mean I'm not at the lowest financial point in my life - still got some savings.
Fortunately I haven't bought any car or house. If not I'll be in deeper shit now.
But imagine going back hometown and people sure ask how's it going. I also don't know how to answer except the truth :/

Not that I hold grudges against him, but as a human I think he failed miserably.

I pulled through, so will you. As for your relatives, those who really care for you would ask you to take your time and find job. Those who just want to watch "movie" , then you can just ignore them.

He just gave me my last salary and told me that I am no longer needed, that I could stay another month with him.

I left the next day, still in shock , and was angry then. The next day when I went packing, he was so "cold" and looked like a distant stranger.

Humans can change in 1 day, amazing.

I didn't visit my relatives that year. Went to light candles and listen to sermons in the temple instead icon_rolleyes.gif

I am also uncle bro. 30 years not young already.
To answer your question - the company is downsizing from 60 to 30.
I am not being replaced. They're closing down a few departments due to poor financial situation right now. A couple other managers also requested to leave.

I guess such is life. Well I was disappointed on day 1, angry on day 2. Now just empty on day 3.
But apart from that I'll definitely be figuring out my next options. Don't wanna go jobless.

actually there is no point to fight for position in a company that does not want you anymore. It's all about rationalizing a loss, and usually it would be very acrimonious.

A good boss, would sit down with their employees to discuss their termination, and give them compensation, or at least give them a few months notice.

An abrupt termination speaks a lot about the nature of the boss, poor communication skills, and lack of compassion and empathy.

go google unfair dismissal, u can bring ur company to court if they just fire u off without warning n without compensation, if they want to retrench then need give at least 1 month compensation

Sorry for what happen to you.

Firstly, do you know the company financial is doing well?
If not, i guess ya boss had decided to cut cost. A lot of company use this approach.

Secondly, seek labor office to get their advise on compensation.

Thirdly, start looking for new job and/or apply grab driver for ya new source of income.

Fourthly, try ya best to stay calm. Believe u're having mix emotions.

stay strong bro. spend time with family during cny first. when everyone sleeping, you can fire up jobstreet start apply job d.

If got cable, apply those cable one.

if no, apply 10 jobs (no joke), open rice more important than face.

i don't think they have the right to dismiss you without any show cause letter. your employment contract is your best chance of getting an even compensation if you want to bring this up to the labor office.

wow, if fire u just like that, u can report already. when they got reason also pointless. they can't claim the reason afterward. u can go to labor department and claim ur guaranty compensation. should be 45 days of wages. 22 days is 1 month so u should be about to get 2 months plus.

anything u can ask me here. coz I'm 99.99% sure u can get that. even they got reason also pointless already, they should give u several warning letter. now they give u nothing and dismiss u, they can't counter claim again.

my boss oso owe suppliers over 1 year and making lose last year. luckily got bonus last month but this year we are prepared to get fired.

mine is a chinaman company so my boss is careful with labour law.

a friend of mine last time western company here when retrenched, no warning given. Morning go to office like usual at 10 am terus all kenak buang. Such a surprised but that'd how Westerners do.

retrenchmen law quite strict and usually in favor of the employee.

refer your case to the Jabatan Perhubungan Perusahaan Malaysia.

they will peruse your case and call your employer for a meeting.

your remedy during the meeting is reinstatement. the employer must prove that their company is really not in a good shape economically.

in case of retrenchment, employer are also required to provide sufficient time/notice to you in lieu of compensation.

Err, given your age and salary, I suggest that just let it go. It's very time consuming to file the case to the industrial court. Unless you are age 50 and financially strong, then you can play play with your boss in court.

TS,

HR dept very busuk wan....they ask u leave verbally without giving u a letter..... u take their word for it and did not go to work.....

In their official report, they will say did not turn for work for 3 days and force to sack u immediately.....

no matter u enter a or leaving a company, always get a document for it.....all verbal promise is just talk cock...
