We call this guard banding.
Imagine if they calibrated it to follow exactly actual speed.
But due to error of measurement / tire diameters changed due to wear tear, and you get summon on AES although meter at 110km/h.
Now in that situation, would you sue Proton?
Short answer, it's on purpose. Slower by 5-10km/h to avoid outside factor errors.
