 Courier parcel sign by unknown person, Is it legal?

Is it against the law / courier service policy to allow anyone to sign for the package?

I've lost my package at the moment and their proof of delivery is sign by an unknown person at a random time.

Bought item from lazada, pending investigation and the courier is NinjaVan. They provide the "proof" that was sign by anyone but me.

If worst come to worst, they are not taking responsibility, is it possible to lodge a complain to tribunal and win?

Any legal expert, please advice sad.gif

Yes, you are allowed to lodge a complain to the tribunal. Please do. They are supposed to do the necessary checks, either verify the person via IC and signature or verify that the person have authorised another party to collect the package on their behalf.

Most of the couriers flaunt this because incidents are rare, but I fully endorse that you lodge a report, but a police report as well as a tribunal report.

Luckily so far i never lost anything.
And sometimes i dont even need to sign. I just ask them to drop in tong sampah (inside house) coz nobody at home.
Just give my IC number only

Well, the case is still under investigation. And from the sound of it, it wasn't going well with NinjaVan insisting they delivered it with a proof of delivery (signature by unknwon)

Let hope the investigation goes well and I got my refund/replacement. It's a lot of procedure tho for tribunal .

i've never lost anything too prior to this case.

Did they give you a call when they deliver your item? They didnt even call me and stuff.

All of a sudden, update received with item delivered. the time of signature is very suspicious too.

Can they sign the item themselves even if they outsource the work? Should be no right?

If you have purchase the item with a credit card, try asking your bank what are your options as well at this point. I will also advice you to spread this story in social media, Facebook them, tag them on twitter, instagram, etc..

I think they would have bought some sort of insurance to protect against lost / stolen parcels internally. If they continue to insist, you can also tell them that you shall intend to lodge a police report as well as be filing a consumer tribunal claim. They will be forced to show proof that it was indeed delivered to you.

they do provide the proof of delivery on their tracking number, can see the signature. but it's not mine. i've already screenshot down everything just incase they decide to eliminate the evidence.

Can't contact ninjavan tho, can only email them, which they don't bother to reply. sigh, they don't even have a contact number. worst courier service i've encountered. I wonder why Lazada use them at all. The only thing I could think of is lodging police report + consumer tribunal if they does not want be claim responsiblity.

They shouldn't allow anyone other than me or the person i assign to receive the item to sign for the parcel. Was that some kind of breach of consumer rights?

Yup got call me if nobody at home.
If my dad at home then he just sign no call me.

So it means usually courier just let anyone to sign as long as address is correct.

Btw just recalled got once really kena b4, poslaju said item delivered but i never get.
Called poslaju and later the guy said he send to wrong address, luckily the neighbour give back to the courier guy

Their consignee name who receive the parcel is me as they say. I didnt event saw the parcel. lol

They are supposed to call you and have to verify your IC and signature. Just signature is not enough.

Contact Lazada and your bank as well to see what can be done.

didn't call and stuff. They keep outsource their job to other courier such as Gdex or Citylink. I definitely can't trust a courier service that never send out their own van.

already contacted lazada, they are in the midst of investigation. according to them, ninjavan provide the "proof" and all.

Ninjavan would have to do their own investigation as per the last update from lazada.

Would like to seek advice here just incase the whole thing doesn't goes well so I know what's the next step I can take.

Just drop a stern hint that you are considering a police and tribunal report if the issue is not resolved. Don't threaten, tell them you want to find an amicable solution but you will not accept the fact NinjaVan's response thus far.

finally I receive a call from ninjaVan side.

As per their driver, they say they deliver 3 parcel that time, and they assume all 3 is my package. Only 1 is mine, another 2 belong to another colleague of mine.

Then even assume that all 3 is the same consignee. I've concrete CCTV proof that only 1 package is mine. Let see what they say about this.

At least I have their number now.
