Directly deduct from gross income.
Keep the payment receipt for audit purpose.

Just curious, is it stated anywhere in LHDN ?

QUOTE(Tobyby @ May 21 2020, 11:40 PM)
Wanna ask if the same situation, for the period with no deduct salary for pcb, and also no self contribution of epf record in this period, let say when you do the e-be is it possible to not insert the exact amount you earned for this period? if let say a lower amount? or have to declare the real amounts?
*
There are two things in life that you can't escape: death and taxes

If you have an equivalent EPF contribution, it is easy to reverse calculate the salary amount (which you don't)

If you have any part of the income with digital trace, such as bank into account, or cheque clearing into account, or TT, etc. Unless your income is paid in hard cold cash, and you do not bank in / ewallet any of those amount.
Even if you exchange foreign currency exceeding RM3k, those currency exchange will require your ID/Passport.

If you use the cold hard cash to purchase something significant like property/land, or car, etc. where you need stamping and declaration, LHDN can easily trace and ask you proof your income.

TL;DR My advise: whether it is worth to cheat or not in the long run years/decades down the road, may not necessary limited to 7 years statute.

Can somebody please provide input on this?

https://forum.lowyat.net/topic/5093034

I just filed return for YA 17, 18, 19 yesterday. Taxes deducted via PCB correctly. Tax filing for 2017 to 2019 was done voluntarily (I mean I didn’t kena audit or something).

Will i kena any fine? My honest reason I didn’t file is because I thought deduction via PCB was enough, and I thought the whole filing taxes thing was complicated. Obviously, I was wrong on both counts.

P.S. LHDN eLejar system correctly captures that my taxes were “paid” on each April 30th for past 3 years. This is also via the PCB collections.
*
Late submission fine, if any. Nothing to worry since already happen (late) and worse case is just fine some money. But at least moving forward, your file is clear and up to date, and you don't have to worry about sleep at night, future loan application, tax audit, etc.

Wow, is that really the case? That would be awesome.  smile.gif

Well, I would like to err on the side of caution. Well, I may assume that I can claim the entire mobile phone annual bill (which includes calls, SMS and mobile data) under Lifestyle, but LHDN may strictly allow only pure internet bill (the amount, that excludes the amount for calls and SMS) to be claimed under Lifestyle. This is the risk of over claiming the tax relief, which is undesirable.

Yeah, as you said, my mobile phone bill does not provide the breakdown fee for mobile data.
Nota Penerangan BE 2020 or BE 2020 Explanatory Notes

http://www.hasil.gov.my/pdf/pdfam/Explanat...es_BE2020_2.pdf
Income Tax Act 1967
http://www.agc.gov.my/agcportal/uploads/fi...(30.9.2019).pdf
Explanatory Notes and Income Tax Act 1967 do not really specify whether we can claim bill for mobile phone bundled package under lifestyle.

Maybe, as you said, we can claim the entire amount of mobile phone bill under Lifestyle.
*
Normally bundle is include free X amount of calls, SMS, etc. So if you do not exceed and need to pay extra on top of the bundle amount, then it cannot be separated. If you want to be on the safe side, then claim the fixed bundle amount only and not other subscription / additional usage charges.

What does the first date actually signify? 9/3/2021 in your case.
*
I don't know the exact technical meaning, but my layman assumption from years of submission, is LHDN has processed my submission on 9th March, agreed to accept my submission as final and hence to settle the +/- amount, in this case a refund to me. So the next step is I am expecting refund into my bank account in coming days/week.

Of course, bearing in mind, LHDN has the right to audit at any time within 7 years.

QUOTE(myroy @ Mar 10 2021, 10:45 AM)
any mistake i made, that lead to i have no status shown?
*
Looks alright and correct to me. Indeed you have completed your "2021 submission for YA2020" (year assessment 2020). If this is your first year, perhaps it may take longer for LHDN to review (just my layman assumption). Or if you claim some specific rebates which are trigger point for LHDN, such as house loan interest previously. Recently they may focus on parents deduction by cross-query MyKad numbers.

* My submission time is later than you, even though same day 3-Mar.

Don't look at 2021 numbers for now. That is for "2022 submission for YA2021" which you only need to do in coming 12 months time. If there are numbers, it means your company has actually paid the PCB submission to LHDN.

I would like to help but I'm slightly confused and not understand, if you can provide more clarity on your question. What I see could either be:
a) your company/you did not contribute PCB ?
b) your YA2020 need to pay for tax and LHDN has taken the 2021 PCB amount ???
c) something else...

Yes, it's missing in the main landing page https://ez.hasil.gov.my/CI/
but still can access by clicking:
- Perkhidmatan -> click on the bolded e-Filing
- On left panel, click on e-Lejar -> then click Teruskan
- You will reach e-Lejar main page and can navigate 2020/2021 details

Click on chat

Email them directly, you'll get a reply within one to few days.

Call them up directly as suggested, but during current FMCO not sure if will re-direct the call.

Get all your documents, receipts, claims, deductions ready. Also for the past year(s). Based on history, this long delay seems like trigger audit. sweat.gif

Good luck and do update us here

Hi, for vss / mss person ... how to declare income tax for next year.. since not working anymore.. can give advised? Really appreciated it .. tq
*
Next year not working, but this year worked, right ? 2022 is submitting Year Assessment for 2021.

For VSS/MSS, your HR should do some document submission to LHDN to inform on this. Also they will teach you how to calculate 10k/year deduction for each year of employment. Search VSS/MSS keywords in LYN via google. There are more details which I saw before.

If you resign and not VSS/MSS officially, it is consider as normal resignation.

Yes that is correct.. if lets say this year work until may.. what value to put on the total value since will never get pcb deduction?

What about the next next year after next year? Still need to submit? Since ritired already.. no more income

Btw
Thanks for the info, it really help
*
Assume you 3k/mth work 5 months until May = 15k

Assume VSS you get 10 mths because you work 10 years = 30k
Allowable deduction = 10k/year = 100k

For 2022 YA2021, total up everything
= 15k + ABS(30k - 100k)
= 15k + 0 (I remember can only deduct max from VSS and not from other income)

and declare 15k income, and make sure do submission. Taxable should be zero.

Subsequent years, if you retire, two options:
- yearly still must submit with zero income, keep your tax number open, if you have intention to work part-time or do own biz or something.
- else goto LHDN ask to close your taxation file forever.

QUOTE(kiwifruit0 @ Mar 7 2022, 03:33 PM)
Hi,
Can anyone confirm if employer pay for the annual membership for professional body, can still deduct from gaji kasar?
This amount paid by employer is it taxable?
*
My understanding is like this:
Assume your gross salary 100k
Pro member 2k paid by employer

You need to add back the benefits-in-kind paid by employer into your gross. Hence gross = 102k
Can you deduct it ? No, cause is paid by your employer, and not pay by you.

Is like example if your employer pay for your housing allowance 3k/month, you need to add back 3k x 12 months into your gross as taxable due to benefit-in-kind.
Similiar as if you employer pay additional RM300/month for your h/p or parking/travel allowance, this amount x12 will include into your gross as well.

On the other side of LHDN, I recall the deduction is based on a list of approved bodies by LHDN, need to find or confirm the list. If you pro-body is not in the list, you can't claim deduction even if it is paid by you.

Again from my layman forummer understanding.

QUOTE(kiwifruit0 @ Mar 7 2022, 04:05 PM)
If employer does not bear the annual membership fee
I can deduct from gross pay
Yes and no. It is provided the membership is allowed under the list from LHDN. I don't have the list and LHDN is very vague on this also. Suggest to try ask for the list directly by contacting LHDN and share here.

QUOTE
If employer pay
I need to include the amount in gross pay
Correct. Remember it always as benefit-in-kind.

QUOTE
If i pay myself i don't get taxed, if employer bear i get taxed?
If you pay yourself, it is paid from your nett taxed salary already. Hence it won't be taxed again.
If employer, refer the one directly above that you already stated.

QUOTE
However, the membership is used for the job therefore is not a prerequisite which is non taxable.
Again LHDN is vague here. The only clear analogy I can give is e.g. IR/BEM engineer member is required, cause the IR need to sign documents.

QUOTE
So in this case could it be, i am not able to deduct from gross pay but not taxed as part of bik?
*
Part 1 Q: Correct.
Part 2 Q: If not stated in your EA Form or salary slip, then just submit as-is w/o add the BIK whistling.gif

Hi all,

Recently purchased a tablet under my name (due to promotion, had to buy under my account) but paid for by my gf's credit card. My question is can she claim the RM2,500 lifestyle tax just by the basis of the credit card slip and her credit card statement in case LHDN come asking for audit? Anyone has similar experience mind sharing?

Thank you.
