Just got into a car accident with another Myvi.

I told her to help me with repairs rather than go to police station but she refuse. Told me her car new and she just started paying by for car insurance so don’t mind if NCB reset.

Police confirm her fault later as she charge out from left illegal parking without waiting me to turn left into the parking lot first.

In her case is it better to go report police and let her car insurance bear the cost? She rather pay police summons? Won’t there be consequences if her claiming it with the car insurance company? The emphasis here is she just started paying car insurance so to her OK if NCB reset. First time in this situation, hope sifu2 sekalian can advice.

Below are the pics of the damage. Black sienta is my car with dented left back door. Hers also quite serious.

Since its new car better claim insurance its much cheaper than ownself pay for repair.

Assuming her premium is 2K/year. She gets 25% NCD if no claim.
That is just RM500 add summon RM300 total RM800 "loss" if she claim NCD.

Yeah makes sense then since paying 500+300 still better than paying repairs for both cars with own money.

another question is if my car is more than 5 years old, i need to repair at outside non toyota SC right? police told me my car more than 5 years old repair there will get surcharge 20-30% although i'm claiming the other person's insurance.

edit: yes the above is true, this is call betterment charge, you can google to read about it.

Hi, I going to do the shift in Grab, but I crash into a big truck, in motorcycle land after passing the plaza toll, but not yet exiting the motorcycle land, my father let the bike put it in the small truck, and want to fix right now, and may risk own insurance unusable, but should I do this?

Because Grab just freeze my account after I reported a collision with the big truck, until they unfreeze the account, even with the bike fix-up, I still can't do grabfood.

The bike front cover is broken, front frame is bend, so can't turn left or right, the signal light may broke. no sure the engine can start or no.

But they will replace it with second hand parts

If you want new part, you need to top up a bit

Minor accident. My car Hit by motorcycle from behind. Both of us reported police. Sarjan issued saman to the motorbike rider.

Sarjan recommend a workshop to me. Sarjan said the workshop will handle all documentation. I like the idea of not needing to go to police station again and get the report, the results of investigations and photos. So I want to ask is those workshop recommend by Sarjan trustable ? Or it’s strongly advice against going those shops ?

No. Better refer to insurance company

You don't want to end up in non franchise nor non panel workshop

1. Process will be delay
2. If repair work shady, you can't get insurance company to push the workshop to fix it for free

After clarify. The workshop that the sarjan recommend is actually a panel workshop under my insurance takaful. But it’s not the car manufacturer service centre workshop. Should I be concern about the quality of the work?

Is it ok in that case ?

Hard to tell

If your car is lesser then 5 years old, send to manufacturer franchise. At least can guarantee they will replace it with original part

1. Do you need the other person IC details to proceed, if answer is yes and the person don't want to show ic to you can you still proceed??
2. Is the rule still you have to make police report at the nearest police station or can you just go to any that easy for you???

My car got hit by motorcycles. Police report all filed. The motorcycle was issued a summon.

The panel workshop i went to suggested that i go for OD KFK instead of TPPD, because it involves motorcycle.

The reasons being that if I go for TPPD, the motorcycle rider can still file a claim for bodily injury in near future against my insurance anytime 6 years down the line, eventhough he's clearly at fault and been issued a saman. And my NCD will get affected if it happens and worse still, my insurance company can choose not pay for the bodily injury claim and I have to bear the cost myself.

If I claim using OD KFK, i kind of notified my insurance company regarding the accident. So that in future, if the motorcycle decided to claim for bodily injury, my insurance company will help to compensate.
Problem with OD KFK for claim against motorcycle is hard. As explained in this thread.
Meaning that i would end up burning my NCD. Because they need to lock my NCD for 6 years in anticipation for bodily injury claims. Lock means that my NCD will be reset first, then keep in view refund later after the 6 years period, according to what the panel workshop explained to me.

Is all the above true ? Or the panel workshop just lazy to do TPPD for me. Or like the panel workshop suggested, I would be better off with ODKFK in this case instead of TPPD for the extra peace of mind 6 years down the road.

I can answer the first question. No need IC to proceed for police report.

Most important is to get the vehicle model and plate number. Best if you have dashcam footage. If not, try to provide photos of the scene, dont move your car or motor first, all this is evidence.

Second questions I'm not sure. But I think best is to report at nearest traffic police station.

2. You can go to nearest police station to lodge. The system will link you to the correct station and assigned IO will contact you immediately

Just go for OD KFK

Insurance company will temporary withhold your NCD due to potential TP injury claim

None the less, most insurance will then return your NCD if you appeal for it

Standard criteria to succeed in appeal
1. Biker got saman
2. Biker not seriously injured
3. Biker did not hire lawyer to sue against yours insurance

As long as you are able to correctly identify the vehicles involved

If you are worry, just snap photo of the car with number plate visibly seen, the road tax sticker and maybe a photo of the driver will do

The other party is not obliged under law to produce his IC as verification
