I bought broadband modem huawei E372 43.2 mbps via this XXXXXX's E store.

But when I received the item, it looks totally different from the one in the picture he posted in his thread, the one I received look like a fake china brand which is totally different from what I have seen on the internet.

I private messaged him and enquired but he told me "*Operator logo may vary, subjected to stock availability". Besides accusing me not being observant, he also said I didn't do my part as a customer. Hello are you kidding me, how many types of huawei E372 are there?

Please beware of seller like this, he will send you different item and tell you the functionality is the same. How I know the functionality and the quality is the same?

Is it even the same thing?

You don't have stock of that particular item then don't post the picture of it, post the picture you WANT TO SELL. Don't say subjected to stock availability craps. This doesn't make sense.

6 years of business..sigh...luckily you encountered customer like me..

if that thing is huawei e372 then shud be no problem..u more lucky if its already unlocked..
mine maxis..has to pay rm17 to use dc-unlocker..

I will react according two mentality, First typical Malaysia mentality : tak apa lah, even two brand different but it is still same broadband modem, as long it can be use, nothing to fuss about. Second develop country mentality : Nooooo, it is not same in term of brand, spec and function. you have cheated me, i have right to return the good and get a refund.

Sebenarnya betul jugak points yang diberi oleh beberapa /k. Aku dulu kerja Maxis, dan aku boleh kata semua broadband depannya logo Maxis. Tapi produk tu semua produk Huawei. Dan warrantinya dari Maxis lah; itu point sebenar logo Maxis ada dekat situ, walaupun produk Huawei. Maxis nak ada produk buatan sendiri? Jangan haraplah. Tapi mungkin salah seller jugaklah tak clarify semuanya betul2

First of all we have clearly stated on our thread and our website that "*Operator logo may vary, subjected to stock availability".

Therefore it is the buyers responsibility to check with us on what logo that we are going to send as we have indicated.

The problem here is the TS was not observant by not heeding our indication in bold.

If we did not state, it is our fault, but the thing is we have already done our part.

We have several types of logo with the same modem's model which is going in and out such as T-Mobile, SmartTone, SFR, "3" and the list goes on.

What we assure here is Huawei E372 with such indicated frequencies are supported and the our units are unlocked.

Below is the diagnostics report for Huawei E372U-8 (Smart Tone)

(2,13,14,16),(0-3),((2000000400380,"GSM900/GSM1800/WCDMA900/WCDMA2100"),(4a80000,"GSM850/GSM1900/WCDMA850/WCDMA1900"),(3fffffff,"All Bands")),(0-2),(0-4)



Therefore we have complied by providing a unit with the correct supporting bands as below

Band :

3G: DC-HSPA+/HSPA+/HSUPA/HSDPA/UMTS 2100/1900/900/850 MHz

2G: GSM/GPRS/EDGE 1900/1800/900/850 MHz



The TS bought Huawei E372 and we sent him a Huawei E372. As indicated operator logo varies and we sent whatever is available according to our stock availability. We did send the TS Huawei and not by any other manufacturer. It is made by the same manufacturer with the same functionality.

SmartTone is just another network provider like Maxis, Celcom, Vodafone, Singtel and so on.

We assure all the units being sold by us are original / authentic and moreover we have given the TS Huawei's contact details to verify whether the product is original or not. Assumptions won't solve any problem.


Finally, the manufacturer is the same (Huawei), the model (E372) is the same but the operator logo differs as per indicated by us.

No foul play here on our side but lack of observation by the TS. Therefore we are NOT scamming here but just making things straight and easy.

Honestly, to be frank, we've been going back and forth with you (TS) and clearly do not seem to understand simple English of "*Operator logo may vary, subjected to stock availability".

To end this hideous madness, we will provide you with a full refund for the ITEM ONLY, provided that the item is in the same original new condition with its complete packaging and etc.

*Do take note, if you are planning to go ahead with the refund, the item must reach us by Tuesday, end of the day. Otherwise, consider the offer is void.

i dont think he knows what he's got or what are the terms. People never read before buying. I know.
it was someone else that post a link which suggested that it was a 7,2

TS should have -
1. seek clarification from seller or ask for a refund. if that seller refuse then come and post
2. he should have done a speed test and also there are various ways to find out what frequency is this working on

I'm not saying that buyer shouldnt be pissed in getting something which is not as stated at seller's thread but he should first seek answers from the seller. And other sellers shouldnt come add fuel to the fire

But remember, if TS wanna sell the stuff in garage sale....put the picture as HUAWEI and dun forget the word "operator logo may vary"

Wow, I didn't think that Hua Wei's logo would be so important on the item

The true honest way of selling an item would be to post the original product and then there would be no ambiguity. The onus would be on the seller to then show that the product is the same as Hua Wei. The buyer is then given the choice as to whether he wants to buy it or not.

How would the buyer knows whether the chip inside is Hua Wei or from another company?

one is 7.2 speed basic type as shown in link below

The item is made by Huawei as it is clearly printed at the back of of the item.

It's like saying the outside casing quality is not an issue, what's important is the inside specs. But casing is important also. I see the one with Huawei brand is more expensive that other telecommunications logo one.. You pay the price for the Huawei one.. But u get a different one which should be cheaper

TS if it works well, works fine to you don't fret.
Read all the manufacturer and modem specs on the box, manual and the hardware properties inside Ur computer.
If its a Huawei E72 chipset then it's fine.
It's just virtually visually different.

The real question is how much U paid for it?
If U pay mahal2 for a reference Huawei model but dapat that one then yes U are somewhat scammed.
If U pay cheap U dapat telco-unlocked model la.. Habis cerita.

Whatever it is,that was inappropriate to advertising using an original product image,but deal with 3rd party overlay brand.might as well just advertise the 3rd party overly brand that r actually selling and claim it was the same thing as 1st party originated.

This is not about cheaper price or not.this is the etiquette of business.not willing buyer or willing seller in this case.

The TS bought Huawei E372 and we sent him a Huawei E372. As indicated operator logo varies and we sent whatever is available according to our stock availability. We did send the TS Huawei and not by any other manufacturer. It is made by the same manufacturer with the same functionality.

SmartTone is just another network provider like Maxis, Celcom, Vodafone, Singtel and so on.

We assure all the units being sold by us are original / authentic and moreover we have given the TS Huawei's contact details to verify whether the product is original or not. Assumptions won't solve any problem.
Finally, the manufacturer is the same (Huawei), the model (E372) is the same but the operator logo differs as per indicated by us.

No foul play here on our side but lack of observation by the TS. Therefore we are scamming here but just making things straight and easy.

Honestly, to be frank, we've been going back and forth with you (TS) and clearly do not seem to understand simple English of "*Operator logo may vary, subjected to stock availability".

To end this hideous madness, we will provide you with a full refund for the ITEM ONLY, provided that the item is in the same original new condition with its complete packaging and etc.

*Do take note, if you are planning to go ahead with the refund, the item must reach us by Tuesday, end of the day. Otherwise, consider the offer is void.

I'm not saying that he tampered with the logo. Say he have a new one sitting there but from Vodafone. Would you still accept the refund? This is how TS felt. I'm not saying whose wrong or right. Just trying to put you in TS's shoe. You're doing good considering you're offering the refund.

- "Operator logo may vary" doesn't mean that the whole thing include shape of the unit, packaging, hardware spec, etc.. itself included is varied. sweat.gif "Subjected to stock availability" <<< seller MUST always inform the customer prior to any means of delivery via anymeans... If seller did inform their customer prior delivery then seller = thumbup.gif Only deliver once the customer agree on their end. If customer complaint why late, at least you have the bullet here..

- "Customer is always right" <<< this kind of mindset has been nailed on every buyers. Yeah, it hurts the seller, which is why as seller, they take extra step to ensure no aftermath dispute (my comment on stock availability subjection is one of them) sad.gif

- At most, seller terms before any purchase agreement is:-
i) item exchange to same as advertised
ii) any other model with same advertised specs & value
iii) higher spec & value (this one customer have to top up)

- Your refund time frame is kinda choking the buyer. Well, i can't comment any further on this because different seller have different refund time frame smile.gif

For this case, if TS ever brought this case to tribunal = 100% you lose.

if you were to post something else that is TOTALLY not the same from the picture you posted REGARDLESS of manufacturer, you need to at least inform buyer beforehand, not after buyer receive the item and start complaining.

the term "picture is for illustration purposes" means not exactly 100% same but doesnt mean it will be 100% TOTALLY DIFFERENT item.

Selling is a simple concept:

1) U show the photo of ur item, describing it
2) buyer interested with the item and spec, paid for it.
3) buyer EXPECTS THE EXACT SAME ITEM AS SHOWN/SEEN earlier to be received.

Any seasoned seller won't risk sending a different item although functionality is 99% or even 100% same.


btw, even if the item is exactly the one from photos... but "looks" less pristine (torn/scratches/stain) upon arrival... still considered "not so good" also.

There are idiotic sellers online, once i order a tablet casing, item receive is different, when asked seller says its generic 7" casing. Generic or not, it is not the item posted on his page. Proceed to post a negative review on him, not only he did not apologise but dare to ask me to drop the comment in order to get refund. _l_ him

Yes, i agree, its this kinda sellers than give online business a bad name....ppl now prefer go to shop to buy rather than online cos mumbo jumbo dispute...I even bough online a RM2K handphone which had a dead pixel...cannot return wan...and when I did return...they didn't repair it and come back all scratched up...

No stock as we already mentioned via PM to the TS.

If the TS sends the item out by Poslaju, it will reach the next working day.

Therefore we feel Tuesday is sufficient since the TS can do it today, tomorrow or Monday (3 working days)

I'm not a seller of electric and electronic items, and neither am I a noob about rebranded OEM versions of devices. Speaking purely as a consumer, there has to be greater clarity and forthright disclosure especially in online sales. We can only see the photos posted, and read the text provided by the seller.

"Operator logo may vary"...fine and good. But this disclaimer does not give any seller carte blanche to substitute items without manufacturer branding (Huawei as per illustrations), different color and different packaging. That phrase merely means that the device comes with various operator logos; nothing more, nothing less. 'Operator logo" is by no means equivalent to "Manufacturer logo".

Accurate descriptions and actual photographs of the items offered for sale would greatly reduce post-purchase dissatisfaction.

Yeah you SHOULD inform and get buyer's consent before selling the item to buyer in this case.

It's like if Nike and another China brand get their shoes manufactured from the same manufacturer. You said you are selling Nike, and you charge me Nike price, but when I get the shoes, I get some random China brand shoes and you said you are right to do so because it came from the same manufacturer and it's the same product, just different brand.

u shuld hav stated "this item comes wif different branding logo due to different telco operators using the same modem for their telco services" , n list down the list of brands for example, vodafone, smartone, maxis, celcom etc instead of just "operator logo might vary"

alot of ppl duno dis OEM thing wan, u hav to explain properly, even though its the same thing wif diferent branding logo, come frm the same manufacturer but not everyone is aware of this

your statement above only cover you on different LOGO e.g. Maxis, Celcom, Digi or whatever that may be printed on the modem. However, it totally does not cover different DESIGN/APPEARANCE, COLOUR. I strongly believe TS has a valid case against you as what he's complaining is the totally different design/appearance.

you need to rephrase your DISCLAIMER statement in order to avoid such dispute in future.

I did not read all pages, but few pages. I believe that seller did not purposely doing it to scam others, just that the disclaimer statement are not cleared enough for buyer to understand fully. I really hope that both buyer/seller would solve this issue with win win situation.

As I can see seller did mentioned "refund" earlier, hope this will help out buyer being feels cheated.

As for cases like this if buyer truly don't likes my items and feels that they being cheated from me provided with acceptable reason, I will refund for my customer and I will pay for the postage fees as my loss.

its kinda stupid that it reaches 9 pages for such a trivial issue. At first i thought that it was 2 different model, but it turn out to be same model just different telco logo or at worse 2 different casing. Its not like paying for Porche and getting a Myvi. And its a bit retarded to compare it with a car even so.

If its already confirmed that its a same model just cosmetically different, then just accept it, as Seller already mention that it might be different operator logo. Unless thats really important to the buyers to have the exactly the same, then just accept the Seller offer for refund.

If i were the Seller, I would gladly refund it as to save this kind of trouble from immature kids.

as long as the base 3g base band can run both, then its ok. i bought a 4g broadband with only 2100 mhz 3g band, my area kampung area can only run 900 mhz, now laying at a side, not from this seller thou.

If they are the dealer for Huawei , why are they selling modem with other telco branding? As far as I know, Huawei don't sell stuff with other brands on it. Like how Mitsubishi don't sell inspira.

The TS bought Huawei E372 and we sent him a Huawei E372. As indicated operator logo varies and we sent whatever is available according to our stock availability. We did send the TS Huawei and not by any other manufacturer. It is made by the same manufacturer with the same functionality.

SmartTone is just another network provider like Maxis, Celcom, Vodafone, Singtel and so on.

We assure all the units being sold by us are original / authentic and moreover we have given the TS Huawei's contact details to verify whether the product is original or not. Assumptions won't solve any problem.
Finally, the manufacturer is the same (Huawei), the model (E372) is the same but the operator logo differs as per indicated by us.

No foul play here on our side but lack of observation by the TS. Therefore we are NOT scamming here but just making things straight and easy.

Honestly, to be frank, we've been going back and forth with you (TS) and clearly do not seem to understand simple English of "*Operator logo may vary, subjected to stock availability".

To end this hideous madness, we will provide you with a full refund for the ITEM ONLY, provided that the item is in the same original new condition with its complete packaging and etc.

*Do take note, if you are planning to go ahead with the refund, the item must reach us by Tuesday, end of the day. Otherwise, consider the offer is void.

It's okay, I don't have any ideas when meteor will be falling down from the sky and fall right onto his shop and his shop get burnt. That is a mother nature disaster right?

or maybe some monkeys released from the zoo suddenly attacked his store and everything is destroyed. That would be sad.

btw, after read few post n explanation from seller, just a misunderstanding here. maybe seller can consider to adjust the description of the thread..

also, seller should be fair on the refund policy.

I find that andrewdavid has answered satisfactorily that he will offer you a refund due to the cosmetic difference of carrier branding. It is common knowledge that underneath the carrier branding, they are the same product made by the same OEM (Huawei).
