DESIGN AESTHETIC

The building design will incorporate steel, glass and greenery into a modern cutting-edge urban campus in a garden setting that will reflect Star’s position as a visionary industry leader. The 5 Towers will present a contemporary even ‘futuristic’ aesthetic setting a high bar for design and construction. The entire site including the Tower decks will be heavily landscaped to establish a green city oasis, enhancing indoor/outdoor spaces and serves to also soften the visual impact of the podium and Towers.

GREEN BUILDING

The development will consider environmental sustainability and reference its success against the Green Building Index (GBI) by

Ya, i think is early this year already launch, but they didn't do much advertisement. But as mention in SPA it will took 48 months to complete, means end of 2016.

I bought the soho last Nov I think. the soho launch last July if not mistaken..
318k, 374sf, mid high floor.
I invest its 63 earlier, then met the agent again and he recommemd take it, small unit, loan rejected unit.
3+3 dis.
compare to the "cstage", I think worth la, free c/p too.
as I know both soho n res unit same price psf, only urs r fully furnish, mine only part part/little...
but is 1 room, so not int...

860psf the best price at the moment. Think about the location and future appreciation. Good location with good potential as hospital, new mix development, new mall in within, Jaya One all within walking distance. What else can goes wrong, especially you are buying family size which is limited within the vicinity.

I guess for sure we "deserve the LAD if late..

News : Jaks Resources’ USJ 1 project on hold

2015 Jun 30

SUBANG JAYA: Jaks Resources Bhd, which expects higher earnings for 2015, has put on hold its plan for a mix development project in USJ 1, Subang Jaya with the softening in the property market.



However, CEO Ang Lam Poah believes that the property segment will still be the largest earnings contributor for the company in 2015.



Coupled with a stable income stream from the construction segment, which has an order book of RM1.3 billion at present, he expects Jaks' net earnings for 2015 to be higher versus 2014's RM14.02 million.



Sitting on a 15-acre landbank, the USJ 1 project was scheduled to be launched in the second half this year, with an estimated gross development value (GDV) of RM1.4 billion.



"Now, we hold the USJ 1 (project) first because of the current situation, a bit of a slowdown especially after GST (implementation), so we'll launch it when the time is right," Ang told a press conference after the company's AGM here yesterday.



Jaks' group senior general manager of finance Chee Seong Heng, meanwhile, expects the USJ 1 project to be launched early next year.



The unbilled sales for the property development division stands at RM400 million, from Pacific Star project in Section 13, Petaling Jaya as well as Pacific Place project in Ara Damansara, with a GDV of RM1.2 billion each.



Pacific Star consists of two commercial blocks – of which one block is for Star Publications (Malaysia) Bhd for the settlement of the land purchased, as well as three service apartment blocks, with a take-up rate of 70%.



On the construction side, Ang said Jaks is tendering for jobs worth RM2 billion and is hopeful of a success rate of 60% to 70% based on the past track record.



The company has an order book of RM1.3 billion currently – made up of water and sewerage infrastructure-related projects and construction of properties, which will keep it busy for another three to four years.



Ang added that building material costs are still manageable despite a weaker ringgit, which increases import costs.



On a separate note, he said Jaks is in final stage talks for its joint venture in Vietnam for the Hai Duong power plant project.



"We've two more (potential partners) to finalise, we should be making an announcement by next month should we are able to wrap up (the deal)," he noted.



The search for new potential partners comes after Jaks' proposed joint venture with Wuhan Kaidi Electric Power Engineering Co Ltd lapsed in April last year.



The Ministry of Industry and Trade of the Socialist Republic of Vietnam had on May 22, 2015 approved Jaks' request to extend the date for the completion of the preconditions of the project.



The build-operate-transfer power plant, which will take 36 months for construction, will provide recurring income to Jaks as it comes with a 25-year power purchasing agreement with the Vietnam Electricity.

The Block C is quite expensive, larger unit but selling price around 1 Million, how many people can afford that.

HI COMPLETION is 42 months if not mistaken, by 2016 DEC?
This is stil under schedule, that beside pacific 63 I bought in 2012 Jan is slower than this star..

Hi all, received 2d progressive payment today and dev ask for the GST about rm2,800, should we pay? While the time we purchased this there is no such GST this thing, now puith putih pay extra 6%, higher cost now, and hv to pay cash!! Imagine those who bought a 3m shoplot earlier (ANY PROJECT) and stil under con now, every cent after 1/4 all kena 6%, any high hand can share some here pls? icon_question.gif icon_question.gif

unless it's expressly and explicitly stated that developer bears it.

after all they are complying to government laws.

so am guessing you are buying an office unit?

Hi bro kochin, is blk B I think, yes is soho, 378sf about 300k I think.
I knew there is 1 dev absorb the gst cos my fren working there, he told me so, not convenience to share its name.
Another case is a lawyer investor also writing to the developer to argue about the gst cos when the time she purchased, there is no such GST and the (our all) snp never mention about it too... so she refuse to pay any so far. She invested about 10 commercial and all progressive payments kena now sweat.gif

Hi bro as informed by developer, construction of podium takes longer time ( about 2 years ) to complete and now they have started with Block Eta, anticipate next progressive billing will be issued by this month and it depends on which floor you purchased. Capella Block construction will be commenting in early next year. However completion for whole development is by end of 2016.

Hi latest news that 28 Blvd Soho Pandan Indah is exempted from GST, new development. So, how about our soho? hmm.gif I believe 90% of our soho or soho in the market, is for residential use too, just it is on the commertial land, so hv to name it as soho? Im not paying my GST yet which due 4/11..

If you can SOHO on commercial land then u need to pay for the GST.

i think is depends on which floor you are.
mine is level 10 and i received the progress payment claims from developer.
Maybe you are upper floor that's why haven receive progress billing.

Are you office/resident unit?
I think bank will only charge you the interest on the release fund since the project is not yet complete
In SPA, it clearly stated it need to deliver within 42 months, so you can calculate when is the due date they need to deliver to you, and the developer need to compensate you 10% p.a if they cant complete on time.

the signature suites unit. before this i was just paying interest, but the bank said they will have to charge full installment eventhough the project has yet to be completed.

i will have to check the loan agreement again because it is joint account with my mom so that time she settle everything and i just sign, now i am having all these headache

Im pretty sure that even by 31/12/16 we cant get the key. Or else we must inspect the unit extremely careful to make sure the quality is stil there. According to the snp is it by 2016 Q4 too? I bought late.

I bought mine in August'2013, according to the SPA, they have 48 months time for construction. So means they can delay up to August'2017.

I dun think they can deliver the house to us by Q4'2016.

Serving interest is the most pain 1, each month around 1K now. putih putih bayar.

My friend condo buy at the same time as mine also get the key and move in d.

Thats what i thought too, the location is not bad, pricing also quite close to is neighbour Jaya One sub-sales and the newly launch Biji at s17, so what is the reason behind the slow sales? After two years of launching, only a handful has been sold, this make me wondering whats wrong with this project

This is a large mixed development project, all small unit (Block D&E) already sold. currently only left with Block C, the price is quite exp (750K++), that's the reason why the sales is slow (just my opinion).

When u see netting around means no end..... could be forever.

Once they dismantle the netting and with painting (exterior) means they will need another 1.5 to 2 years

Once they packed everything as in cleared the site they will need another 6-8 months

i signed S & P with them since 2011, any advice what action should be taken? it is supposed to be completed by end of 2014 as stated in the agreement before implementation of GST. Now we kena charge GST.

and the f8cking bank disburse the amount to them already because they claimed external plastering whereby now it is still covered with green netting.

According to SPA, the developer need to compensate the purchaser 10% p.a interest based on the Purchase price if they failed to deliver the property on time. But looking at the progress of the development, it is likely to delay.

I bought the pacific 63 in Dec 2011, til last Dec 2016...

Is was ald 5 FULL years...

It was ald over the rgpt period....

this is soho..

is is not 10% based on the snp price counting fr the stamped snp date but...

it count based on how much loan was released...

so mot much "meat" to eat actually.. dry.gif

exp, final 15% loan lets say is 30k was released on 1/1/17, and completion date is 31/12/17.

so, developer wil only compensate the 10%p.a based on the 30k =3k to ur pocket only, if...they willing to pay the full LAD..



my snp was dated April 2013, so ngam ngam 48 months now..

close eyes it will take another 18 months the min, or maybe 2 yrs or more based on currrent progressive status.. shakehead.gif

First of all, the developer promised TAR College, a lot of investors went in because they thought easy to lease out ....its CANCELLED

Secondly, the promised shopping mall is now converted to small office I heard....

Thirdly, are you sure Star HQ is still moving here?

Lastly, the delay in the project...if you think you are going to get full LAD, dream on.

All buyers of this project should form a group to protect their legal interests.

According to a friend of mine who's husband is the building material supplier to this project, the developer is facing cashflow issue. The building progress is still on going at the extremely slow speed.

Gather the group and start collecting proof.

All the promises made before you purchased (especially in writing), would help in your case in the future.

Do not let someone to get away easily for breaking their promises, also get a lawyer to write to them and put on record that LAD kicks in now and chargeable at the rate specified in the SnP.

Do remember that your SnP is for commercial property so plenty of provisions are in favour of the Developer.

IMHO, unlikely can complete by year end. Even Pacific 63 not yet complete.

I live in Section 13 so I look at the projects every day.

PJ Midtown is progressing fast ... I think it'll complete ahead of this project.

Dun be silly. If debt can be default so easy, then all the listed company just create more subsidiary and transfer all the debt into it and make it bankrupt, so no need to repay. If like that most of the bank already bankrupt.

Even this project ever completes.. it will be force completion and what assurance in terms of quality and safety? Once a project is delayed automatically the whole property will be affected in terms of value, facilities, management etc.

Never place your money into subpar developers even though they are a public company or properties that are too good to be true.

Ok as developer they were supposed to inform buyers in writing abt delay and possible lad payout.

In yr case pls write to developer with given time frame to reply and pay you.

Or you can engage lawyer to write to them demanding immediate payment.

Lad doesnt need to pay upon vp. As long as developer foresee. Delay they should pay out. But alas malaysia they dun follow rules de.... do study your spa again on lad payment.

I assume your purchase is under schedule H and not those non schedule sovo or sofo or suites.

Hi Guys & Girls,

I am also a Purchaser and the unit I purchased is located at E Block, Level 19.

I have been following up with JAKS Island over the years since they were late for delivering VP and just today, I tried my luck, expecting to hear the same ol', "We dunno when VP will be delivered and LAD dunno also". But to my surprise, they informed that my unit's VP will be delivered by Dec 2021.

I hope this helps everyone, hopefully their units are the same as mine and in the meantime let's all try to contact JAKS and see what they are going to do about the LAD.

Be very interesting to see how a project like this with so much stigma would be priced in an open market.

A design that is 10 years old, a cash strapped developer and a very unfortunate period should be a lesson to companies looking to “diversify into property” away from their core business.

Hi Guys,

Block E owner here, i just got VP today. Funny people dated my letter 16 Dec 2021, Pos Msia chopped 7 Feb 2022 and I just received the letter ystdy.

They are charging 4 months sinking fund and maintenance in advance. With my LAD, crap, i can live there for free for 20 years.

The Court of Appeal in Bludream City Development Sdn. Bhd. v. Kong Thye & Ors and Other Appeals (Civil Appeal No.: B-01(A)-55-01/2020) delivered an important ruling in housing development law last week.

The Court of Appeal ruled that the Minister of Housing and Local Government is empowered to modify a housing contract to extend the time period for a developer to deliver vacant possession of a housing parcel to a purchaser.

This ruling is significant because it serves to limit the effect of the Federal Court decision in Ang Ming Lee & Ors v. Menteri Kesejahteraan Bandar, Perumahan dan Kerajaan Tempatan (2020) 1 CLJ 162. The Federal Court in Ang Ming Lee struck down Regulation 11(3) of the Housing Development (Control & Licensing) Regulations 1989, which empowered the Controller of Housing to extend time for a developer to deliver vacant possession.

In the wake of the Ang Ming Lee decision, a number of housing developers have been beset with claims filed by purchasers for liquidated ascertained damages for the late delivery of vacant possession of their housing parcels.

The Bludream City decision may well serve as a respite to developers as the ruling appears to dilute the effect of Ang Ming Lee.

The Bludream City appeals arose from 3 suits filed at the High Court by purchasers against the Minister’s decision to grant an extension of time of 17 months for a developer to complete the housing units in a service apartment. The High Court allowed the purchasers’ claims and found that the Minister’s grant of the time extension was unlawful in view of the Ang Ming Lee principle.

The Court of Appeal reversed the High Court ruling and made a series of pronouncements of wide effect in the housing industry.

First, the Court of Appeal clarified that the Ang Ming Lee ruling did not mean that the Regulation 11(3) power to modify the terms of a housing contract was unlawful in its entirety or that the Minister did not have the power to extend time for the delivery of vacant possession under that provision.

The Court of Appeal interpreted the Ang Ming Lee decision to mean that it was only the Controller of Housing that was not empowered to extend time. Justice Lee Swee Seng said that “The fact that the Controller has no power to make a decision under Regulation 11(3) or under Regulation 12 in an appeal from an invalid decision under Regulation 11(3) of the HDR”.

It was also observed that “the decision of the Federal Court cannot be read as striking down Regulation 11(3) of the HDR in its entirety. A holistic reading of the judgment must mean that Regulation 11(3) is ultra vires to the extent that it provides the Controller with the power to waive and modify the SPA...”

Moreover, the Court of Appeal recognised that the Minister was in fact entrusted by Parliament “under s. 24(2)(e) of the HDA to “regulate and prohibit the conditions and terms of any contract”” and thus had the power to extend the time for a developer to delivery vacant possession of a housing parcel.

Secondly, the Court of Appeal ruled that the Minister was not obliged to give the purchasers the right to be heard before granting a time extension for the delivery of their housing parcels.

This was because “there is no express requirement of a right to be heard that must be given to the Purchasers, what is important is that the Minister must act fairly, taking into consideration that the Purchasers here, being purchasers, are not obliged to consent to any extension of time implored by the Developer. The Minister is thus entitled to proceed on the assumption that the Purchasers would not agree to any extension of time”.

In explaining this requirement of fairness by the Minister, “the Court of Appeal observed that the Minister would have to “take the broader view as to whether the Developer would be in a position to complete the Project if they are at the same time being saddled with a claim for LAD which worked out to be about 12% of the purchase price of each Unit delayed if there had been no Second Extension”.

The Bludream City decision is of wide consequence for at least 2 reasons.

First, the ruling limits the Ang Ming Lee principle. By this ruling, the Regulation 11(3) power to extend time for the delivery of vacant possession would appear to be valid to the extent that it empowers the Minister (and not the Controller of Housing) to grant a time extension to a developer to delivery vacant possession.

Second, the reasoning of the Court of Appeal sanctions the Minister to consider the commercial impact of a refusal to grant a time extension to a developer. Such a consideration would entail balancing the developer’s exposure to a sizeable claim in LAD by purchasers against the developer’s financial ability to complete the housing project despite having to meet such claims for LAD. These commercial considerations have often been overlooked in past decisions on the subject.

Firstly any idea which creditor file for developer liquidation, they will have the first right to remaining asset then also to find out what remain in developer coffer with this information then it’s more inform consideration for next course of action.

Mind share what the unsettle claims again developer? If LAD need consider the potential sum payout vs cost and time associate with it

Typical of developers. Form a project specific SPV - then go into voluntary liquidation after the project is completed - ring fencing the parent company from liabilities.

Ministry of housing should look into providing solutions.

Actually there are many ways to make the directors personally liable and to bring the listed companies to be jointly liable.

Hi, the developer has applied to court for voluntary winding up and they will name a liquidator of their choice. Creditors mainly are their own bunch of associated companies. Only buyers who have sued them are in the list of creditors. So, for those who have not sued them will be left with nothing. We are urgently looking for buyers who have not sued the developer to form a group on our own. Please drop a whatsapp message to this number urgently. 0125870828 Kevin. We have a nominated lawyer who is willing to conduct a free zoom session to share the legal prospects against the developer. Please act fast before it is too late. Most of then dont require carpark but they need full furnish as they foreigners mostly.

I think this project was stop construction for some year already, those lelong unit is due to owner cannot sustain with late vp and pandamic. i think there are more unit holding by bank and not release one together.
