If you read the review on Hexus, Zotac mentions that all retail models of the 780 AMP! will now use the new BIOS.
the models after the release of the bios.. so those who bought the cards earlier than the date that bios came out are the previous batch(es).. so only LATEST new stock will have the new bios. for people who bought it earlier will have to flash the card themselves

Probably. If that is the case, I suppose Zotac should honor the deficiency and provide a replacement, since flashing a BIOS on your own puts yourself at risk as you could get a bricked card. Hexus has already edited their initial review on the 780 AMP!, but from this link here, some of the earlier review shows that it can't even meet the specified boost clock speed of 1059 MHz.
At the end of the day, #1, #2, #3 fastest cards are within 2-5 FPS difference. Usually not enough to be a determining factor to pick the card. Consider the whole package, cosmetics, pcb design (reference/non-reference), warranty, availability, pricing.
It's odd that the Palit Jetstream and Super Jetstram received underwhelming popularity. They fixed the noise issue and is within 2-3 FPS compared to the fastest cards. Its also a very well priced card. Perhaps it's the color?

Never was there such a thing as replacing a whole card because of bios difference. Flashing the bios on a GPU is similar to flashing the bios on a mobo. It's very simple. People have been flashing AMD cards from 6950 to 6970 back in the days. We are waiting for Zotac to advice how to get the bios updated.

No, my point was not that the BIOS version is different. My point is that a card should work as advertised right out of the box, and if it is not able to perform as per specification, then I see it as a possible "defect" per se. No doubt flashing a BIOS is easy, but the same could not be said for others. You're right, at the very least, Zotac should provide a BIOS upgrading procedure so that people could follow it to the dot, if it's clearly proven that the present BIOS limits the card's boost potential.
It doesn't play the games natively on the tablet. What it does is that it has an AFK mode that allows you to remote play the game from your PC. So now you can lie on your bed and remote control your PC with the Tegra note or with the shield.
I am. Godsend in terms of detection for my 4K display, although synthetic benchmarks shows 200-500 points decrease in 3DMark11/2013. Previous 326.80 beta gave blank display, had to revert to 326.41. Streaming of PC games via Geforce Experience to my Nvidia Shield is also smoother and without much hiccups compared to the 326.41 Beta.

It's okay, I get 6 months productive use out of it, and endless amount of fun at 1600p and 4K max setting. Cant put any $ dollar value on fun and priceless experience.
