Timing of the action of complaint/request for refund is also very important. You should have requested for refund as soon as practical i.e as soon as knowing the defects. If one does not take action promptly and continue to use the product, the law will assume that you have foregone your rights. Besides, for a refund, one is required to return the product in its original condition which may pose a problem if the item has been in use for a while.

Still the best recourse for you is to highlight the detail of the defects in the various internet forum so that other innocent buyers will not face the same problem as you did. If the seller is wise and has good business sense to avoid tarnishing of his reputation, he would volunteer to refund the money to you.

I just bought a watch from bhengsoh, service quite good... amoi too actually

And after comparing I found their price cheapest, if u from kl can straight go to their watch shop too... no need postage so mahfan can check the watch on da spot...

my timing couldnt be more immediate. as soon as i noted he sent wrong item, immediately emailed him about it. even called. he took 1 fcuking week to reply. then send item back to him as soon as i got his address. even skipped my lunch cos wanna go post office. and guess what? he took another 1 fcuking week to pickup the item. now that he has the item, he say got black spots on the watch. waffak? i didnt even wear the fcuking thing, didnt even touch the glass, how can suddenly got black spots? he thinks i nothing better to do simply wear the watch and go play paintball or something before return the watch to him? vmad.gif

oh, he give good service too. i have another seller recommender for nice price and excellent service: virustar.

only reason i didnt buy from virustar is becos he doesnt have immediate stock, need to order. davis, when i ask him got immediate stock or not, he straight away send the catalogue and pricing details. so i assume he got stock. tengok2 he also no stock and have to order. dah la order the wrong thing. dumfuk.

takmau report awal2. tak pasal nanti dia lagi bising lagi takmau refund. sekarang gua try cara gentleman dulu.

kalau bro tengok thread sales dia pun, tak banyak good feedback. banyak feedback buruk je, cuma orang malas nak bukak dispute thread. bila ada orang komplen dia service slow sikit, terus emo reply "we dont sit in front of pc 24hours a day, so might be slow in responding. please dont expect us to be online here all the time". emo siallllllllll.

Then in that case you have a good case against him. Gather your written correspondences/proof with him and lodge a complaint against him to the Ministry of Domestic Trade (website enclosed in 1st post) and let the consumer tribunal decides. You got nothing to lose except for your time. Do not delay as I have said delay can work against you as the law may assume that you forgo your rights. Let unscrupulous sellers know we consumers have our rights!

The model I wanted many seller even shop no stock due to consider new design... online I asked mostly RM129 - 149.... I saw at Isetan RM 239 .... many watch shop I went all around kl no stock

Bhengsoh price is lower then above stated price by bits... anyway mine is Casio LRW-250H. Bhengsoh help me order as no stock also, I don't mind waiting 3 weeks as its cheaper plus I can pick up at the shop and check on the watch throughly
