Details of the complaint :
On 10Jun2010 (Thursday), around 7:15pm, I bought a Nokia E72 from ajepyatt, COD at Menara Optometry Centre Sdn. Bhd. (Address: No.44, Jalan Tun Mohd Fuad Satu, Taman Tun Dr. Ismail, 60000 KL).

As per what ajepyatt said, this handset was a reward by Digi. According to him, everything is in place and original. When I came back home, I was shocked that the MicroSD card is missing, the original package for Nokia E72 come with the 4GB Micro SD with PC suite in the Micro SD, included in the handset. Immediately I called him and told him that the Micro SD card is missing, he told me that this is the package he received and it's without Micro SD card.

I requested him to check with Digi, but eventually he said he had called Digi and Digi cannot do anything as he had signed the shipping form. He also offered me to buy Micro SD card from him as he is selling Micro SD cards and computer as well. I felt that I'm being cheated, even now I called him several times, but he did not pick up my call and reply my sms.

I hereby provide the shipping details (the shipping form, from Digi to ajepyatt, he gave me the shipping form as the proof of purchase)

Lesson learnt: Never trust any seller, even if they are friendly to you. Check everything on the spot.

The TS sales topic never mention got the 4GB Micro SD, you should ask him regarding this before you agree on purchase, and not only complain after you brought it. . . I don't think TS will con you for a cheap 4GB Micro SD. . . and I also lol on you for making police report on a cheap 4GB Micro SD, I wonder they did accept your report?

Thanks for your comment. Yeah, it was my mistake that I trust him that everything is in place and didn't check for the Micro SD card. But as he said, everything is original, everything in the package he got from Digi, it's ORIGINAL, not AP. Afaik original package for E72 should come with 4GB Micro SD. Maybe to you it's cheap, but I'm the buyer, I hope you can understand my feeling if you were me. And he offered me to buy MicroSD card from him without asking Digi. Actually I hope we can settle it by ourself, but he didn't reply me or answer my call. Oh yes, the police had accepted my report.

and from the pic also im not see memory card there..

but,.who's know seller got reason for that..
he stated there rm1000 fix..
he sell to you rm960 w/o mmc..and he know u must be asking about memory card..
so he plan to sell to you..so he can get more than 1k..

TS i think u shud discuss this matter with seller i dun see this as a con case.look at others thread.most of them got cheated with huge amount of money from hundred to thousand.you are very lucky to have a honest seller and it just involve a MEMORY CARD.why just not discuss with seller about giving u a free memory card.and ur hp is avaxx ,original set ,where got new 1 below 1k?

There are many different memory card, the one come with Nokia can set password and can be locked. I did discuss with this seller, he ask me to check with Digi, it's a little strange if I talk to Digi since I'm not their customer. He didn't want to listen to me anymore, and he offered me used memory for rm70. I just treat this case as a lesson to me.

lets me explain this from the begining

first ) i WTS mg E72 that i god from digi from digi without memory card ( i not mention any micro SD 4gb in my thread) but after COD he check that items not complain and after that he call me ask about the memory card and i said to him im onli got 8gb used if he want i sell for rm70.

second) the price 1000 firm not pm me about any best price - BUT HE STILL PM ME ASKING THE BEST PRICE EVEN SMS ME ALSO - AND im still layann him very nicely and give more diskaun for my phone and closed at RM 960 and i told him even RM 1000 is came without memory card.

third ) i said to him my offer RM960 is until 5.00pm onli bcoz i got others buyer higher than him bcoz i want sell witgh " first come first serve basis' - STILL BUYER CALL ME HE ONLI CAN COME TO MY PLACE AROUND 630PM TO 700PM- i said to him i stick to whos come first if he come first i sell to him lah. and he come at 715pm than i sold to him and lost my higher bidder.

forth) im already give him time to that the items izit original or not and i saw him look at IMEI number same with the box. He not asking me anything about any memory card that time he paid me RM960 cash. and im ask him to give me the nokia ear phone bcoz im give him diskaun and i want that but he dont want to give me and bcoz that include at my pics i cancel that.

fifth) im giving him my business card and he promise me to bring his family to my shop.

SO WHICH PART I CHEAT HIM and my conclusion is this buyer sudah banyak kali bagi muka bagi muka bagi muka lagi mahu pijak kepala orang kaaa depend to u all to judge.

but ALONG if u read this im still offer u my 8gb TOSHIBA class4 for RM70 if u still want micro SD. plz dont call/sms/me i dont want make any business with u again secoz u sudah pijak kepala gua. better change ur name from UBUNTU to ALONG - bcoz u know what i mean.

For TS ,some phone really dun have some assesories even nokia state tat is include ,like last time i bought n95 ,should include pouch right ,but the batch i bought , all n95 not bundle with pouch

i dun think ajepyatt should responsibile on this case ,because seller never mention include micro sd (but seller mention full set,hahaha,i dunno why) ,but since buyer know package is bundle with micro sd ,why u dun speak out during COD coz normaly people will test the memory card also (this is the second point)



conclusion - seller offer e72 din state memory card ,u buy mean u accept it and even during COD u also din say anything ,but after tat u bising here ,wat for , u pay and u leave after COD ,mean u accept the phone and satisfy with the phone ,u cant do anything after tat

im not really sure that full package is including microsd

bcoz i got this free from digi whay im asking more tha what im got i also not a handphone dealer that must know everthing about the phone

im also not force him to buy from me im also told him that he can go to NOKIA CARE to download a PC software

now this is consider as buyer fault ,and for seller ,nxt time mention everything u have ,is to prevent this kind of thing happen

And you ask me to give you the handsfree as a gift because the price we agreed is already very cheap (of course I didn't do so). I've contact Digi customer care yesterday and they haven't receive any call from you as per what you said. Can you clarify this? They advice you (Digi customer) to contact them directly.

Oh yeah, Don't you remember you told me the phone is exactly the 'original package' you got? Now missing 2 items, MicroSD and PC suite inside.

Maybe the package you bought is AP set? From what I know original contain everything.

Ya, bang. I agreed what you said we must appreciate what we have. But I just don't like to be cheated (I'm not saying you, ok? It's either Digi or you didn't include the memory card).
I just ask a flavour from you to clarify with Digi, that's simple only, that's all I want, I hope can get back the micro sd. I even call Digi and send email to them myself.

What was stated in the box?!

On the box, it would state all the accessories included. If there's no mentioning of the sd card, then it's not included. Simple as that.

Even if the set is from DIGI, DIGI doesn't have the right to open up the packaging even to include one SD card into the phone.

i sudah call itu digi that night before i send u sms

digi said they cannot do anything bcoz i already sign/accept the shipment

last time i beli phone mmg tarak memory card takkan i mahu mintak lebih2 bcoz this is reward i sudah check everything

Bang, are you sure you already called Digi? They look into this matter and their feedback is asking you to contact them, not me. I did received their email as well.

When we meet you said everything 'ORIGINAL PACKAGE', now something is missing, but you didn't even help to clarify with Digi, is that so difficult? Just tell the truth, tell them that the package you received is without MicroSD, that's all. And now you said I'm kecoh?

To TS (UBUNTU): he didnt state he will provide memory card, so it was not part of the offer he offered u, hence, even if u bring this to court, u wont succeed. it was your fault for not reading and accepting the fact that the seller did not include 'memory card' in his package statement regardless of what the original package may be.

and also, next time if u want to complain about these small things, go buy original brand new from nokia shop. sure 100% no problem.

To Seller: you are definitely not at fault, probably a little rude to offer a second hand microSD at a high price. but its ur choice. with regards to this situation, you are clean and clear of any fault.

this TS remind me that last time i got a buyer bought a RM25 network card from me

then he said network card got problem, fine...i exchange another one for him, then he said he dont want exchange and asking for a RECOND network card AT RM5-RM10 and asking me to refund RM15 to him...

He didn't cheat you to began with cause he had never claim the availability of the MicroSD card in his sales thread to began with, nor did the picture described of such item.

Again, like I say; check the box. On the box itself there should be somewhere stated what accessories is included.
This is how one verifies whether the package had been tampered with.

For now I think it's better to close this topic.

However, after you've checked the box and found that it is really missing; then you may open this topic back. Then I guess no one can fault you on that.
