Hi guys, I'm actually conducting a study on starting a restaurant business somewhere either in a shopping mall or in a stand alone independent shop.

I'm only 19 ):

So can you please help me out by letting me know

What are all the legal necessities of running a restaurant. What are the permits/licesnes and fees which I have to apply for/pay before I can start my business

As far as I know

I have to register my company with the SSM (suruhanjaya syarikat malaysia)

Then i have to apply for a license from the local municipal council

Halal certification (if necessary)

what else is therE? please enlighten. I will appreciate all the help given, thanks a lot in advance.

Hi,

Depends what type of business you want to register.

A sole-proprietor, Partnership, Private Limited.
If you are owning this business alone, and do not have business partners, then you should go for sole-proprietor [it's cheaper than registering a private limited] though it does has it's downsides. Registering a private limited would protect you from a lot of liabilities, but it's more expensive, probably around RM2,000 if you hire people to register for you.

That's the registration part. Next you have to see if you want to get the 'HALAL' approval or not. Then there's also business premises permit etc. There's really alot to look into. Good luck smile.gif

Oh like that means.....TS either you register your business as Ptd Ltd take 1 Muslim cook as partner, or employ a Muslim cook and still keep your business to solo propertiership smile.gif

The halal thing I'm not too concerned, even if I dont get halal certification its okay

So basically

I have to register my company with SSM (suruhanjaya syarikat malaysia)

then get the license from MPSJ/MPPJ or osmething is it

for ppl doing warung la not only have to have SSM and Majlis license they also need to get some vaccination from hospital... but i dont know if this applies to ppl doing restaurant

Check the traffic of the mall vs the shop.
Build a Profit and Loss forecast by month for 2 years. Change your assumptions and see how this will impact your P&L. Then you will have a better idea what is required to sustain your business under different scenarios.

Few stuffs I can excrete out for you:

1) Chefs - where are you to get them, the legality of it (foreigners) and their visa requirements.
2) Standardization of food quality and taste - one chef's cooking differs from another. You know how to cook, but how are you to run the business if you're doing the cooking all the time?

seriously i appreciate all the concern and wadever not

but im really looking for all the LICENSES/FEES/REGISTRATION which have to be done before I can start a business

because there is a portion of my project

which requires me to list it down

so far

the ones i know is the ones wehre i have to register my company with SSM
then i have to apply for a license with the municipal council
then perhaps Halal status from jakim

wad else people??

Remember the Fire Department as well. I think you will need to pay some fees or buy some fire extinguishers from them.

Water bill, Electricity bill lehh....need to think that also la brother...and the most IMPORTANT thing is the price of your food vs your competitor...If you can produce nice and cheap food, AT LEAST, you are safe already.. biggrin.gif

It seems the most important part has been ommitted. You will need tons of $$$ for reno, equipment, deposits etc tongue.gif

i just want to know, the legal and governmental formalities that i need to fulfil before I can run a business. No need to worry about my capital, no need to worry about my premises, no need to worry about my human resources, no need to worry about my costing, no need to worry about my plates and cups and forks and spoons and cups and coffee machines and ovens and microwave ovens and sinks and lights and fans and airconds

Yeah, you will need a work permit for all foreign staff who works in the restaurant, even the owner will not be exempted.

TS,

if you want to open a restaurant, i think you have to submit your shop design layout as well. u need to get it approved b4 u can start renovation.

As long your design renovation is within your shop landscape, there shouldn't need any approaval. Unless you do extrude balcony, beam & etc then you may need approval.

if you are opening up a restaurant as a foreigner , probably you need to check their site

What condition must be met if a foreigner wishes to be form a company ?

A foreigner who wishes to be a company director must be above 18 years of age and have a principal or only place of residence within Malaysia (Section 122 of the Company Act 1965).


Not sure if this applies to Sole Proprieter. but i guess there is a hint up there. biggrin.gif

Are you really into opening a biz? You sound to me you are more of doing an assignment and just need input. Who on earth would do a biz without considering the capital? If you are doing a project, just let us know, we can give you direct input.

thanks to TS for creating this thread..

me n my frenz plans to start a cafe business somewhere nearby Kuchai Lama/old klang road area.. now in d midst surveying d location...
we will mainly targeting student/sales pple to hang around for normal hours and working adult for lunch time.
or better location to recommend?

and now we only plan to spend RM100k as a start for f&f, rental deposit, kitchen crew, renovation... izzit enuf?

Non of us hv experience operate a cafe b4... but the chef (1 of d partner) was working wif parent in a restaurant b4 join us..

We plan to hv ROI within 6-9 months, izzit to slow?

Really, just register everything and ask bomba to check and approve it. Restaurant or kedai kopi, both have diff criteria to meet. You need to check with them.

What is more frustrating is your rude attitude and your lazy mindset to ask for help in your assignments/research without any bit of effort to seek out yourself or go interview F&B owners but rather be spoon fed through this forum.

Majority of us here are not in F&B industry, so please direct your questions to the appropriate group of people instead of us here for spoon feeding.

yo bro, i can see that you have a very low limit of tolerance and a very high level of temper. The combination of these two might bring whatever business down, believe me. In real business you need probably 100 times higher limit of tolerance and 100 times lower level of temper. Your attitude has a big role in your business, so stay cool. No need to be jumpy. I'm not a pro in business but all you have to do is to ignore all negative replies towards you and only take positive replies into account. There are many other obstacles you might face when your business is running which might raise 1000 times the temper compared to what you are facing in this forum.

If you can't tolerate answers given, then this isn't the right place for you.
Do your homework else where.

If you're not lazy, you would have found your answer by conducting interviews with those who're really in F&B industry. All it takes is a trip down and ask. Simple isn't it? But no, you wish to do your homework here, demands answers, and scolds everyone whose answer wasn't what you want.

Is this how you do your research?
