I was practically checking on mudah, lowyat, any websites that is not blocked by my ex company during my serving period. I took 1 week to hand everything to the new guy and was sitting at my desk doing nothing.

Terminated = not nice. Save yourself some dignity and time for future explanation.
Resign = Better compare to being terminated. At least you voluntary to leave the company in good terms.

Future companies might find out that you were fired after calling your previous employer. They have no obligations to cover your bekside. I think is best you cover your own and resign yourself unless you have a very valid reason that they terminate you with prejudice.

The reassignment/transfer will be a major variation from her existing job scope and no official memo was given to her. Only thing is a JD. She was told to clock in at 8.30 at HQ but disallowed to enter office and then travel to the assigned outlet and wait for the shopping mall to open at 10am then she may allows to leave at 6.30pm. This is considered lenient as they deserve the right to ask her to follow the operation shift time of 10am to 10pm.

To her, this is completely unacceptable and she ask to leave the company immediately. The company then without hesitation offer her 2 optinos. Option 1 being that she leaves immediately but without salary/compensation pay-in lieu up to the last day of her notice period. The company will only pay her until the day after raya and the balance of her AL.

If she refuse, then she must take option 2 and go to outlet store to serve her remaining notice period there and disallowed to enter the HQ office. This utterly absurd arrangement and a trick by the company to force people out without paying them the compensation.

Because of the transfer and reassignment is done in such a short notice and the nature of it being a serious demotion and variation from the existing job plus an insults to her, in a way it is a dismissal forced by the company instead of the staff asking to leave.

Anyone know what is her rights and would it be fair to demand the company to compensate the salary up till the last day of the notice period?

Check your LO. If stated 3 months, better serve all three months else might face legal issue. The money might be small amount to pursue, but if they really chase you for the amount, you will have hard time as well.

Better check with the HR and the contract you signed. See if there are any clauses indicate the x number of months to serve notice. Also, do check with your direct superior see if they can let you go without any compensation.

Employee/employer can terminate each other with 1 month notice, that is valid. So for your point 1, it is legal to do so without providing any reasons as long as they give you a month notice.

As for point 2, usually the employee has the options to choose for, if want to turn AL to money or directly deduct and serve shorter notice. That I believe you need to check with HR directly since every company have different policies. Like mine, any AL you did not use, terus burn. No carry forward to next year, no cash. Only when you resign you can turn your AL to money.

You don't need reasons for termination as long as they fulfill the contract criteria; give x amount of notice period and pay accordingly. Honestly I don't see any issue in this termination.

Don't risk it. They put so that they have the chance of suing you for breaching the contract. If you had to, either you talk to your immediate superior about releasing you early, pay the full amount of unserved notice, get your future company to payout (mind you, some companies do payout but have certain T&C for you to sign) or you serve the entire 3 month notice.

Leave with good terms; as you don't know when you needed their help in future.

Usually will offset so you can leave early. But why want to offset them when you can turn it into cash? I reckon you should email to your HR and notify them you will serve FULL notice and convert those unused annual leaves into cash. wink.gif

This is best if you could check with your HR. But I believe you don't entitle it if your role in the company is completely changed, ie: change of work nature, direct superior, department.

If a company only give you better pay because you are leaving, IMO you shouldn't stay. Also that depends on the difference between the new salary adjustment and company B's offer. If you think the amount is significant enough to cause a difference/impact, then you can consider to stay.

I believe you can talk to the HR from company B and see how they work. But I can tell you that you are burning the bridge to company B if you do that.

I'd say leave. Counter offer is to provide an offer that is higher than the current one, not match the current one. But if you think you can settle with it, then by all means go ahead.

Does the potential employer know that you need to serve 3 months notice? If yes then wait until you get their offer letter, go through and agreed/sign on the LOO. Then you send the LOO back to new company and at the same time tender your resignation to your current company.

That should be the correct way to tender without getting your work in risk. wink.gif

No company can request employee to resign unless you fire me with valid reasons. Bare in mind even if you are fire, the company required to provide a legitimate reason of your dismissal. Else you can bring this shit up to labor office and sue them.

But if this company is causes stress and discomfort and like you said, it's dominated by people who are very much involve in office politics and family relationships, you shouldn't stay long in this company. Might as well just move on.

SOP - You sign LO from another company, return to them, they confirm received, then you tender. Give some buffer time as your current company might ask you to stay for few days to handover completely, give and take 40 days, so 1 month 10 days. If they did ask u to stay further to complete handover, let them know that's the period you can stay. If they did not request, then take that extra few days off to clear your head before you start your new job. smile.gif

Insurance wise, my company only do my own insurance. Not whole family unless you are at least manager above level IMO.

Then do you mind paying it yourself? If yes then don't bother reimburse. Take it as an additional course to market yourself out next time, IF you really do not want to get bond.

But before they ask u to attend the training, did they mention anything about bonding? If no they cannot be asking u to sign a bond letter without stating it beforehand.

You have already passed probation? Or still under? And is the x date a total of 30 days, as per your offer letter? If yes then you are safe. If the y date asked by your employer is the correct 30 days, then you gotta serve until then.

Nothing much would happen but you definitely got blacklist and spread around if the industry you are working at is small enough.

By the clause, yes you are not allow to offset your existing AL to deduct the x amount of days for notice period. But do check if you can turn it into cash else you rugi besar. doh.gif Cannot deduct cannot turn to cash.

Once you signed an agreement, you are bind to a "contract" and they reserve the right to ask for compensation. Why would you want to sign such deal? hmm.gif I have reached out by a recruiter and I never sign any pre-agreement with the recruitment company for the job also. That should be between the recruiter company and the hiring company.

Depending on how their payment collection like. Some collect half when you start work and another half after u pass probation. Some collect full amount prior commencement of new job.

Seem to me that your recruiter doing the earlier ones. If they found out they could not collect the remaining payment because you resign, they reserved the chance to claim compensation from you.

But do pray to God/Buddha/Whichever religion your belief is that this does not happen. laugh.gif
