Got a question. If I have a gift card for amazon.com, And if I purchase more than RM500, but using the gift card would offset it, to less than RM500, but the total items and shipping are worth more than RM500 , would we still get taxed ?
*
hey im also a bit confused on the whole tax issue in malaysia.

when do they actually tax you. just for things above rm500? or everything they find?

Your CIF must not exceed RM500 to avoid TAX, but we are still susceptible to random checks by Kastam, if they find some dubious stuff (in their minds) it goes to Finas/KDN.

CIF is = (C )ost of Goods, (I)nsurance and (F)reight (shipping)

In other words, your total cost including those factors cannot go over RM500.

They will refer to respectable Govt. dept. if your item get taxed. In our case, Blu-ray/DVD/CD movies is under Film which is referable to Kementerian Dalam Negeri, Lembaga Penapisan Filem, FINAS.

So in event your Blu-ray/DVD/CD movies get detained by customs, u need an import permit for your films. If the said Blu-ray/DVD/CD movies is for personal usage, u need a "pengecualian import permit' letter from Lembaga Penapisan Filem, FINAS. Without either this document, it impossible to get your package out from customs. But tax still applies (according to your CIF value) even u get the permit.

but i tell u, finas work is damn slow. it takes ages to approve your 'pengecualian permit'.

my experience thought me that, never use your company address as your shipping address. FINAS will recklessly thinks the Blu-ray/DVD/CD movies is for commercial purposes and your 'pengecualian permit' will never get approved.

happy importing

because i experienced it myself before. okay, in order to get the "Pengecualian Permit", u need to draft a letter (states that this blu-ray/dvd/cd movies is solely for personal usage), your CIF declaration form (Customs will provide this), and your original purchase/shipping invoice. So means that u only eligible to apply for this exemption if your package is detained and customs already provide you the CIF declaration form. then u need to send all these documents to Lembaga Penapisan Filem, FINAS to get the approval. IF u use private courier (DHL, UPS and FedEX) they will handle all these steps for u, u only need to draft the letter and fax it to DHL Customs officer.

Then, once u get the approval form FINAS, they either post or fax your approval letter to you, and u need to forward it t customs to get your package cleared.

if your blu-ray already detained, no matter how long, you can still apply for the permit exemption frm FINAS. But if u didnt get the exemption letter, your package will stays at customs indefinitely.

once, i put my office address as my shipping address (you know, there's nobody at home during daytime), FINAS officer recklessly rejects my application saying that the package is for commercial. So i have to drag myself to putrajaya, and appeal for the approval. Meet the FINAS pengarah there, he saying that all film goes in the country must get filtered, then i have to go to the court to declare my blu-rays is for personal purposes. what the heck! then i make muka kesian and appeal nicely to the pengarah. then he said he will review my applications. IT took me damn 4 months to get my blu-ray cleared.

If u use private courier (DHL, FedEX, UPS), they will call u. If not customs will call u, and im sure they will not. So u have to call customs and check yourself, but u need to have the airway bill number or the tracking number.
