They need to have the license to collect the tax. These licenses can only be obtained by having annual sales of RM3 million. Even if they hit the target at year end, they still can't collect the tax yet. Once they have hit the target, only then can they apply for the license. So by saying they are "not sure" of their annual sales, meaning to say that they have NOT obtained the license.

Why dont they just drop the whole tax idea and make our citizen lives easier? Bunch of fools with no IQ.

Without Tax, we dont need to worry about our "rights" and nobody will charge those tax illegally.

And it is not like I want to bring the whole list of Legalize restaurant that are allowed to charge tax to customer.

And the license of Royal Malaysia Customs can faked easily. So those can not qualified can easily be "qualified"

now with some can legally tax, some can illegally tax, we as a citizen have to waste our time to identify between them. If the restaurant is making 3Mil per anum, those 5% tax mean nothing to them. Such policy is like helping the rich get richer. The big guys can charge tax, the newly open small restaurant or mamak stall cannot tax. LOL

Now I have more reasons to vote this BN out from our Gov.

i am interested which outlet which has been taken away the rights to charge 5% instead.

NS and Melaka is 0 because, not even one restaurant in the state are eligible to charge service tax. Means, their annual sales can't reach RM 3 million to be eligible.

As pointed out by Jordy, its in the list..

NS and Melaka are not actually 0. The restaurants that are eligible to collect the tax are all the big franchises there.
So, only the name of the Master Franchise will be listed. All other branches would follow.
I do believe that KFC and McDonald's in NS and Melaka are doing RM3 million sales annually though.
So, please check for the Master Franchise's name in order to find out if it is eligible smile.gif

Mind you though, some restaurants have different name with their registered business name.
You need to check their registered business name to make a confirmation.
If still it is not in the list, then you can lodge a complain to the Customs department.

thanks the infor..

I always hv drink in mamak during weekend at the Aman Suria,near the tropikana. The Nasi Kandar Penang no more charge the tax, but very funny is.. the nasi or mee goreng charge RM5.20.

Ask him why got extra RM0.20..izzit already inrease the price? He jz smile only.. Me and my gang wondering is oledi insert inside the price..

Well, that is still the weakness in our system now. Although the service tax on these premises have been abolished, still they can find other ways to charge that little "extra" smile.gif As long as they do not charge that service tax illegally, nothing that we could do.

As informed by my friend (a hotelier), the 10% service charge is only imposed if you dine-in at the outlet. If you do take-away, you won't be charge the 10%. His reasoning is that, when you dine-in the staffs will have to serve you the food, entertain whenever you call to ask for chilli sauce/tomato sauce/pepper/tissue/whatnot. Whereas when you do take-away, they just prepare your food and off you go.

I don't know whether this is applicable for all outlets, I'm sure it should though, but whenever I did take-away at McD I didn't see them charging 10% on my receipt. Different if I dine-in, then they'd charge the 10%. Not sure about now whether they still practice this, long time never eat fast food already. Would be nice if somebody who dine-in and take-away can keep their receipts and clarify this.

From what I understand, the 5% have to be returned to the government.
