It will not be usable in Malaysia unless:

1. He pay an unlocking fee from the respective telco in US. Provided he also paid the whole 2 years of contract.
2. Or... you unlock the phone using software tools available (Currently only for iPhone OS v3.01. For update to 3.1 you need an OS file without the baseband firmware)

Assuming your dad is returning to Malaysia by air and the phone is packed into baggage, he can pass through customs check point undetected. If for some reasons he is 'picked up', one iPhone product isn't that much of a problem.

All phones coming from US is all locked. So if your dad doesn't know about it then it'll be surely a locked phone. There are 2 possible scenarios:

1. If your dad bought the phone as a contract (because he works or resides there):
You can't just unlocked it by paying a fee. Unlocking service is only provided upon completion of 2 years of contract. Unless they provide an exception you're allowed to pay the whole 2 years of contract in advance.

2. If your dad bought the phone outright via a prepaid plan (because he's a tourist, etc):
Then you're allowed to pay a certain amount of airtime in exchange for unlocking fee. That way you can unlock the phone legally.

I may be wrong though since I am not familiar with the scene in US. Best is for your dad to consult the telco personnel before leaving.

It will be held at the custom. You have to buy an AP from SIRIM (if not mistaken, it's around RM200.00) and also you have to pay for the custom import tax about RM150 or RM200.00.

hmm in customs malaysia website, HS Code 8517.12.000 states no duty NO TAX. why is there still tax having to be paid? the same code is quoted on apples website too. Does this mean Customs is pocketing the 10% tax they charge on
the phone?

Look at the attachment below.
