And he had a chance to let go the already severely injured victim, but rather let him die. A bit of commentary, in Malaysia, courts expect self-defence to be used moderately. For example, if the robber come rob you, and you have a gun. If he come at you, and you shot him, its self-defence. On the other hand, the robber see you have a gun and tries to run away, and you still shot him dead. Likelihood, this will be murder (only concelation is bunuk tanpa niat). Like the snatch thief, clearly he is escaping, but the bystanders manage to catch him and belasah him until he dies. If encouner this type of situation, just take out phone record, go balai report and claim insurance. Never step out of the car, prevent harm to your family or injury to yourself. If safe to do so, just drive away. |
