A former IT consultant who caused the death of a bank manager in a road rage incident six years ago had his sentence reduced from 16 years to 12 after the Federal Court allowed his appeal on sentence.

A three-member bench chaired by Justice Noordin Hassan said the original jail term imposed on Yew Wei Liang by the High Court and affirmed by the Court of Appeal was excessive.

“We think the sentence is a bit high,” said Noordin, who sat with Justices Vazeer Alam Mydin Meera and Lee Swee Seng.

Yew was seen sobbing in the dock while his family members appeared relieved after the court’s verdict.

Lawyer N Sivananthan told reporters that Yew, 47, should be freed in 2027 after taking into account a one-third remission given to prisoners for good behaviour.

The bench earlier dismissed Yew’s appeal to be sentenced for a lesser charge of causing death without intention.

The bench also disallowed the prosecution’s cross-appeal that he be convicted of murder, which would give judges the discretion to impose the death penalty or up to 40 years in jail and a minimum 12 strokes of the rotan.

Deputy public prosecutor Ng Siew Wee represented the prosecution.

Yew was initially charged with murder after repeatedly running into Syed Danial Syed Syakir, 29, on the North-South Expressway near Bandar Baru Bangi on Aug 10, 2019, resulting in his death at the scene.

On Dec 7, 2023, Justice Julia Ibrahim found him guilty of a lesser charge of culpable homicide not amounting to murder.

She sentenced him to 16 years’ jail, backdated to the date of his arrest on Aug 10, 2019.

The Court of Appeal dismissed Yew’s appeal against his conviction and sentence in March this year.

On Aug 22, 2019, Yew was charged with the murder of Syed Muhammad Danial, 29, at Kilometre 293.6 of the PLUS Highway (Kuala Lumpur-Seremban) between 1 pm and 2 pm on Aug 10, 2019.

In the cross-appeal, Deputy Public Prosecutor Ng Siew Wee argued that the High Court judge erred in sentencing Yew for culpable homicide instead of a more severe charge.

The accused stated that the incident happened quickly, but the prosecution argues that despite the short duration, it does not prevent the court from inferring an intent to cause harm and death under Section 300 of the Penal Code, she said.


She argued that in his defence testimony, the accused stated that he saw the deceased (Syed Muhammad Danial) rushing toward his car while holding a baseball bat, prompting him to shift gear from reverse to drive before hitting the victim.

The accused said that he felt his life was in danger and wanted to protect himself and his pregnant wife who was in the vehicle at the time, she said.

However, she said, according to the video recording of the 19th prosecution witness, who is the accused’s wife, at the scene, he was not acting in self-defence or to protect his property (car); instead, he was angry and intended to teach the deceased a lesson, adding that the 16-year prison sentence was appropriate and not excessive.

Meanwhile, lawyer Datuk N.Sivananthan, who represented Yew, argued that the incident happened quickly and that his client did not intend to commit the act.

He was blank (disoriented) at the moment and the act of moving the car was purely in self-defence to avoid being hit by the deceased with a baseball bat, said the lawyer, who also requested the court to impose a seven to eight years prison sentence.

prosecution say anger, defecene say dissoriented, how do they know wat is YEW thinkking at that moment,

The victim wanted to whack Yew's car with a baseball bat. Yew hit the victim & pinned him to the divider. He refused to release the victim even wen requested by other road user. The victim died from his injuries. Yes was deemed to hav used excessive force beyond that necessary for self defence.

Hitting him is one thing. But he still refused to release the stuck victim even wen other drivers told him to do so. That is murderous intent oredi.

With average lifespan at only 75, a 12 years jail term is as good as deducting 16% of his lifespan. Still not enough?
