My first sentence was referring to usual case, not referring to this case. You use side mirror and see no moto but when want to change lane suddenly there is motobodo..... so. whose fault?

In this case, the car make sudden decision and brake to change lane to stop. Whether he was looking at his side mirror or not it does not really matter, The car behind him can brake but if motobodo has too much difference in relative speed to the traffic flow, then he cannot stop in time. Many things could have been done to avoid this accident:

1. moto shouldn't undercut
2. moto shouldn't abuse emergency lane
3. car should have made sure left side is totally clear before committing the turn
