He is a mage in UBW, but a low level one. Thus why he can be the master of both Rider and Gil-chan

Ilya's heart is the core for the Grail to manifest itself hence Gilgamesh decision to rip it out of her chest. Shinji have low level magus ability thanks to his years of scouring the forbidden books of Matoh family and can be used as backup plan for summoning the Grail after Gilgamesh failed to acquire Rin for this purpose.

Ilya was a homunculus designed specifically by Einzbern clan for the Grail to materialize in real world.

Yeap, the fish scene did not make sense to me and the movie made one crucial mistake, Rin saw Shirou keep jumping the high jump when they both were very young, not high school as shown.

The sex scene made a lot of sense since it is creation of bonding between 2, spiritually and magically. After all, body transference is one of skills of magus in Nasuverse.

Another clan famous for body transference ability are the Hojos, seen in twins Kohaku and Hisui from Tsukihime story. Since the Tohsaka magus knowledge specializes in knowledge transmutation of magic and storing (Rin's jewel spells and Sword of Zeltrech), sex idea made a lot more sense than fish thingy.
