 Tribunal for consumers claims Malaysia [TTPM], Advice if to proceed

I filed a report to KPDNHEP and the outcome said I need to proceed to TTPM.

I read through briefly the function of this tribunal, seems like a court cause have hearing date like that.

Anyone have been trough this process before?

before this I only at KPDNHEP level, everything settled, now for this case need to go to TTPM. Should I proceed? I lost RM1660 due to undelivered product.

I know won't really get the money, my intention filing report to KPDNHEP for advice whether need to file police report, then come /k ask where to deposit details of this kind of conman.

You provided KPDNHEP with all the necessary data they need? I also contacted them before, scammed 1.5k+ but they found the owner and dealt with the owner. They were the middle man, all settled, a few of us kena, also from lowyat. but then 3 of us banded together and got our money back. Others not too sure. the conman dont wanna return? if dont wanna return thats why need to go tribunal. very long and tedious process. if he dont show also waste your time and effort.

Yep. No report police, cause no use, police also cant do much. thats why report to kpdnhep. they will assist in getting your money back. mine was because the scammer asked to cash deposit into the company account, to make it seem legit. but then, after 3 weeks, no update. keep saying need wait need wait. so yeah. already get the hint. i guess yours a bit complicated cause only got name, phone number and account number. cant work much with that. one of the victims bought the company details and provided it to kpdnhep, so they found the scammers address. they went over the house and look for the person, saying they have a few reports of scamming. ask the owner of the company go their office to discuss. in the office the officer said got 2 options, num 1, you as the owner, refund the money to the victims, or 2, victims submit ttpm and then must attend court at specified location. so the owner of the company said settle with refund. so the officer contacted us and asked us to provide the receipt of the cash deposited. then the owner refund back, case closed. 3 of us got back our money, and we split the document purchase amount to one of the victims who bought the documents and found out. haha. what an experience. xD

With only name, account no. and phone no. I don't think you can bring a case to TTPM. They also need his I.C. no. and address. You should go ahead and make a police report. Maybe the police can do something.

Police report a must
Consumer tribunal, court will send letter to them to attend hearing, its not those court like we see in movies
Just a judge n both party
Maybe get a lawyer can advise?

Taking a scammer to consumer tribunal is pretty useless. He is unlikely to attend the tribunal and you get nowhere.

Prevention is better than cure. You made a bad judgement to deposit money into a stranger's account and got burned. Take it as a lesson from the school of hard knocks and buy from a reputable online platform in future.

ayam went to the hearing before, tyre shop damaged ayam's rim,
badly scratched, just simply mask with paint, ayam complaint kpdnhep,
say need go tribunal, ayam prepare all the document, sent via kpdn web,
then still need hand over some docs to the respondent, went there, shop refuse to receive, end up send via AR post,
then when court date came, ayam show up, and won the claim

it started with some small fixes and fans installation, the handwork was unsatisfactory. but my wife too nice wants to help especially during this covid time, plus saying it will be more expensive if buy from a proper shop.

i know I won't get back the money, the KPDNHEP report also to seek advice if need police report, also anyone here in LYN know where to deposit conman details? I saw 1 website which listed lots of scammers, but couldn't find how to contact them to deposit info.

shop refused, I assumed they didn't come to court also, and judge just sided with you? but I think your case consider still easy cause got address, physical shop. I guessed if cannot be contact or located cant do anything.

nope, the tauke's wife went to the court,
they tried to argue on the fact that i didn't request them to fix it on the spot,
judge straight say "you dont say that, some ppl go back see their stuff got damaged, they sakit hati, it's your job to fix what you've damaged"
they offer send to fix it , ayam say either they pay up, or ayam send to other place to fix, they pay the bill, downright say to their face, i just simply dont trust you

yeah, claimant are required to notify respondent on the intend to claim, in your case,
maybe just report to police and BNM, if you deposit via bank account number, maybe bnm or pulis commercial crime dept can blacklist it

Police or BNM cannot help if it is unsatisfactory work from contractor, if it is outright scam please make a police report ASAP!

For the case of contractor, if you have more info like full name, address / company details etc, you can go to small claim court if the involved amount is less than 5k. The process is quite straight forward and effective. If the defendant did not show up for hearing, the judgement will be in your favor and an order will be issued for payment, and if they still do not pay up the court will order seize of asset

Tribunal is more like a middleman and help both party to come to terms and resolve conflict

ya the unsatisfactory work still can let go. so I think this one falls under scamming/cheating. unfortunately, I don't have the address cause this is private/personal services. anyway, thanks for the info. will go do police soon.

I have an experience making a claim once, about 7 years ago.

I bought a GoPro from a shop in The Curve. At first it was fine, but after a couple of weeks, I found that the sensor was defective. So I returned it to the shop I bought to get it fixed (was still under warranty).

The shop informed me the camera will be sent to the regional service center in Singapore and would take a month for inspection or repairs. But never after a month still no call from the shop.

I followed up, shop said wait a couple more weeks. So I did. But it dragged for a few months and the shop ghosted me.

When I called the Malaysian GoPro regional office, they were unable to trace my camera.

Frustrated, I submitted a claim at the Tribunal. They told me that I can claim for an item replacement or equivalent value of our losses. Since I need the GoPro for my trip, I requested for a replacement for the item.

When we submitted the claim, a demand notice was sent to the camera shop via registered post, where the shop has to sign they received the demand notice. I was notified by the tribunal of the delivery as well

A couple of day later, the shop gave me a call to collect a replacement for my GoPro. Didn't need to attend the hearing even.

Was massively relieved when I got that call.

For me, filing the claim at the tribunal was very much worth it.

thanks for sharing. based on all the reply I guessed TTPM will work best if we have the seller/service provider/conman address information.

Which option is more appropriate for small expenses dispute amounting to only rm200? What is the differences between these two?

Tumpang tanya: if a tenant has dispute with landlord wrt supposedly ridiculous damage claims by LL (deduct from deposit when moving out), can the tenant file report to Small Claims Court or tribunal?

i think the investigating officer will give ultimatum if no show. because if i remember when the officer called the owner he also said to the owner you want to settle this the easy way or the hard way? i think the owner was a lady. probably scared thats why just settle by refunding our money. if kena those dont care one maybe need to go tribunal. sweat.gif
