Oh really? I always got the impression that residential hsing with fencing and guarded is GNG.

If this the case, what is the term for all the Impians & Indahs.

Agree. Nowadays SA landed props no more suitable for flippers.

Even the medium cost apartments subsale will face tough competition from the Rumah Selangorku units in the future. I believe most potential medium cost own stay buyers would be trying to get a RSK unit now.

Only duta villa is strata title and only duta villa is the proper GNG in setia alam.

Indah and Impian are fencing n guarded @ FnG

Proper GNG= parks n road inside community is belong to the residence and maintained by residence or RA. Outsiders can be blocked from entering.

FNG= parks n road inside the community belongs to the public and maintained by town council. Outsiders/ non residence CANNOT be blocked from entering as the road n parks belongs to public.

Half agreed. Should refer to the land title
if individual title. The road and garden inside the community is belong to government. RA no right to block outsiders from entering
If strata title. The road and garden inside the community is belong to private. RA GOT right to block outsiders from entering.

Another main problem is maintenance fee. sweat.gif sweat.gif

Although individual title, dmc could be enforced to solve the maintenance fee problem.

No, guarded only
Hearsay leftover 2 or 3 units.
FYI setia alam only got 3 areas are GNG
1. Eco park - individual title with DMC
2. Setia damai - invidual title with DMC
3. Duta villa - strata title with DMC

** so call only duta villa is proper GNG under law. "

its just like a definite contractor employment but enjoy exact same benefits with indefinite employee

So far what I know is yes. RA can not do anything If the owner refuses to pay the maintenance fee even they signed the DMC.
Coz Landed GNG only can under strata title according to law. DMC VS LAW. Which one is bigger?


The thing become worse after MOT done and got more and more sub sale transaction.
1. sub sale buyer no need to obtain letter of consent from RA or developer to proceed the MOT.
2. Since no need to involve the RA or developer. If u are the sub sale buyer. Will u pandai pandai go and sign the DMC with RA or developer ? If they ask u sign. U oso NO need to bother them. biggrin.gif biggrin.gif

Since the RA hv no right to stop ppl for entering ( some more the guy got property) and the RA oso can NOT STOP anybody to proceed the MOT. So.....

By the way, if my understanding is not correct. Pls share ur experience

My understanding is that the DMC is signed between the purchaser and the developer. Under the DMC all rights and responsibilities of purchasers and developers will be spelled out including matters related to the usage of the common properties, payment of maintenance fees, security services as well as the running of the management company.

In theory the gated community concept depends on the principle of mutual consent of parties to the contract. Thus any non-compliance with the contract will enable the innocent party to initiate civil action.

Having said the above, however, I do agree that the DMC is not enforceable on the sub purchasers.

The legal action only can be taken for for those signed DMC for strata title.
If dun mind. Pls help to find any case, owner sued by developer or RA due to refuse to pay maintenance ( the property after MOT done ) which the property is GNG under individual title.
Really wanna to know the outcome oso.
So far, what I know is RA only can keep issuing remind letter biggrin.gif biggrin.gif and reprogram the access card. At the end, for those refuse to pay maintenance fee, they will entering the area as visitor. biggrin.gif biggrin.gif
