In short, i pre-ordered an item from cyra thread (http://forum.lowyat.net/index.php?showtopic=42389). In Item Code: [Magazine][RO] D002, the item shown as only the pic scanned from magazine (http://i172.photobucket.com/albums/w22/izatIsmail/pre-order/D002.jpg). As you can see, the item shown on the image has a BLACK skirt. But in reality, i got a brown skirt. (Note: at this time, there was no other info available on the item. Only pic)

So, cyra agreed on the refund of the total cost of the item (rm 55 = dress + shipping). But cyra would not cover the postage of the item back to her. And there's where we stuck at.

I meant, the item cyra gave me was not the same as advertised (false advertising). Not to mention lack of information (cause cyra didnt have the actual stock in hand), I want to return this item back to her but only with the condition that she fully refund + plus shipping to her...


What you guys think?

everything has been well explained by spayre up there. I just want to add another few points:

1) I already mentioned that I haven't seen the item since they are pre-order... and all information that is available is based on what the supplier gave me.

2) I understood if spayre expects to receive a black color dress since that is what it looks like on the picture, but due to lighting... it is a normal case that there will be slight color difference between the picture and the real stuff.

emm spayre....on ur side ...as customer....sure u want to get refund full (if same happen on me...i do hope for refund) and u r dissappointed with the items...poor of u... sweat.gif

But on cyra side (as trader) she has mention she haven seen the items before by state clearly in her thread...she already agreed to refund u the skirt....she is quite nice already....coz as my exprience in LYN...i saw many other forumers/ traders in stuff for ladies (those pre-order threads....) even dont responsible for an difference occur on the items...and dun even refund $$ as they say they stated clearly......

both of u are having ur own reasons...so if u 2 can tolerate bit...i think this case can solve more easier....just my 2 cents....hope u 2 solve this ealier and happily!! Good Luck~~ laugh.gif

If it were me, i'd just pay for the postage myself
This doesn't seem like the seller did it on purpose, just to handle it nicely i wouldn't mind losing a few bucks
After all, the seller too will be losing the same amount

There's no clear cut right/wrong here, so if both of u keep refusing to pay the item is most probably gonna be stuck with you forever with no refund wink.gif

hmm.. ok i understand where you guys are going at... some say that the value for postage is too little to argue with and i respect that ...

but

1. as a seller, regardless of wrong info or less info given by supplier, the seller should bear all responsibility, right? why should i also bear the same responsibility? I meant, if u advertised black (i dunno about lighting but that black sure looks like black!) , ppl expect to get black. now i am not getting black, plus i need to pay extra to return the item back to you??? i believe this item send back to you will be sold back, so ur profit can cover the postage, right?

2. is not the matter of postage, is just that as a seller, you should bear all responsibility on the items you are selling. If u say return to you for an exchange for black, that i can understand. But now, I am supposed to send back to you and also cover the postage? Am I not at a loss? I need to pay extra to return an item that i dont want. In the end, I got nothing but losses...

3. Is just a matter of trading etiquette, you should bear responsibility as you are the seller. If you sold something that was different than you advertised, you should bear all the responsibility. If you are not willing to refund plus postage back to you... no offense, then you should not be selling then...

4. Dont tell me that ur profit margin cant cover postage for an item that was totally different than you advertised?

so if someone drive all the way to shopping mall and pay for the parking. Then bought a t-shirt and found out size doesn't fit. Went back to exchange for bigger size and ask the sales person for petrol money and parking?

when u buy a shirt, u can see the size and color, right? no false advertising, right? u can see the item, right? U can touch, evaluate and even test the item before buying...

plus, what u mentioned is exchange not refund. if u do an exchange, u waste parking, time , toll and petrol but what u get? the item with satisfaction of your standard. if cyra offered an exchange for a black skirt, then i would not object for handling the postage fee

but now, it is a totally different situation cause now it is a refund. which i have to suffer losses due to

1. lack of info given by the supplier to seller (that i need be held accountable for?)
2. cyra should have informed me of the color diff when she got the stock before delivery. if i knew it was brown, i would turn it down and save all the hassle...
3. the customer (me) got a good diff than advertised. And to claim back my money, i need to suffer losses again???

Like it or not, this is the weakness of online purchasing

So back to the pic, does that mean that u simply ordered it without stating what color u wanted?
If so, you're just as much to blame for not requesting it in black as much as she is for not telling u it's brown (as 1 of them in the pic is actually brown)
She could use the same argument that a seller is not responsible if the buyer did not state nor ask clearly before purchasing

@cyra,
did you state in your thread that this product(the skirt) is black ? and only black?

@spayre,
sounds like the colour is really important for you,
did you emphasize during the trade that u want and MUST want only black colour, do not want any color other than BLACK..not even a single digit HEX Color code difference ??

and even so...
whenever a customer is not satisfied with the product received,
it is a common practice that the buyers pay the postage for the retuning.

and abubin had a point there..

if I were the buyer, i will feel glad and appreciate that she is giving me full refund.

if I were the seller, i will just pay the shipping charge(it is RM6 only duh)to avoid time wasting and hassle, but in condition, i have to receive the product in good condition first before paying doing any refunding.

it is not just about the money... it's about attitude. I really don't mind to pay the RM6 if the buyer is well-mannered and not being rude to me especially when he/she is requesting something from me that is not clearly my fault.

Truly, I believe it is part of my fault.... that is why I allowed for a refund and willing to give a full refund (which includes the shipping cost from me to spayre)... but I don;t think all the blame is on me alone... and based on this I don't think I deserve to be treated rudely.

In any case, I still am only agreed to give a full refund but not the return shipping cost.
