Unfortunately individual titled even with DMC is not governed by SMA.

Strata Title Act ( STA 1985 ) was an old formed of a legislation to govern the sub-divided of the buldings and parcels, until the issuance of strata titles, but back then, it is applicable for apartments or office blocks. There were too many errors and too many confusions. Hence, it changed and changed and comes out an idea of the establishment of Building & Common Property ( about Maintenance and Management ) 2007, which is in line with STA. Old lawyers called it BCP 2007 but new lawyers called it STA 2013.

Manyak confusion, but was told, both emergenced of BCP 2007 and STA 2013, is about not only sub-divided of the stratified buildings or parcels, but also comes into a proper management to manage and maintain the said buildings, where the appointed management must be involve and in this case, where under constructions, the vendors ( developer ) must be properly stated into the agreements that subject to new management company is appointed or subsequently takes over by JMB upon 12 months of VPing.

Hence, that binded agreement is DMC, the second seal agreement beside S&P. This is accordance, lawfully and legislated by STA 2013 ( or 2015 Amendment which enforced 1/6/2015, notably on high rises ) bcz all properties or parcels falls under STA 2013 must signed DMC. However, a property with DMC, in this case, an individual landed, is not necessary must be stratified but just a form mutual agreements btw vendor and purchasers in a group form and subsequently passed on to future purchasers.

My worries was remains the last sentence as how the enforcement can be properly done to, if a new buyer of subsale for individual title but with DMC prior to 2007. It was a challenge bcz DMC back then was confusing.

In this case, reputable lawyers clearing the doubts, keep on enhancing it and improving it, notably on behalf of purchasers. I believe new purchasers with DMC would be more protected, however, let's see by 2018 and if there are differences or common issues incurred.

Chris boss, based on my limited knowledge, I understand that the SMA governs only the stratified development and individual-titled development is excluded even if there is DMC in place. As for the DMC, even though it can be put in place for both stratified & individual dev, the difference is there is a proper legal framework, ie the SMA for the former while the latter is purely governed under contract law.

In the case of subsale after the strata / individual title obtained, while I'm not sure how the existing DMC which was signed between the original buyer and developer can survive and continue to bind the subsequent buyer for the case of stratified development, that cannot happen to individual-titled project.

Yes, generally the interest rate will be higher for commercial loan comparing a residential mortgage loan of same quantum and tenure. Mine one is 4.55%.
