Tried to submit the e-Filing since end of March but always failed to receive the TAC. Just a sharing for those who are having difficulty to receive TAC for submission and are not able to talk or chat with the customer service.
You can file for a compliant here.

They replied in an hour telling me they deactivated the TAC submission for my account.
*
Since they had deactivated, then you can no longer able to receives the TAC?

Not sure if that is going to be just a one time thing. But after they deactivated my TAC, I just clicked on the verification button, keyed in my password and submit.

End 2018 make news splashed need declare only 50% income 2018-20 then early 2019  changed to only for year 2018 in low key sigh..

Watch out landlords out there
*
an article in Dec 6, 2017, by a legal firm mentioned....
Tax exemption is given for a maximum period of 3 consecutive years of assessment from 2018 to 2020.
https://dnh.com.my/budget-2018-tax-exemptio...-rental-income/

Appendix 2 of this from LHDN also mentioned the same
http://lampiran1.hasil.gov.my/pdf/pdfam/tax_appendices.pdf

they changed the condition in early 2019 to reduce that 3 yrs to 2018 only?
mad.gif ranting.gif that is bad for many of those that does not know the latest changes and had been filings as per "old" info.

Thanks for the updated info.... notworthy.gif

just a reminder for those that have not done your "duty".

Deadline around the corner

With many caught focusing on other matters during the recovery movement control order (MCO) period, there is a risk that many might have overlooked the extended deadline granted for filing tax returns.
The deadline for tax returns has always been April 30 (manual) and May 15 (e-filing).

This year, the Inland Revenue Board (LHDN) extended the deadline to June 30 due to the MCO enforced on March 18.
According to the LHDN, the decision to extend the deadline was made after considering the constraints faced by taxpayers to submit income tax return forms.

However, it had reminded taxpayers not to wait until the last minute to file their tax returns.

Hi, Need an explanation on this:
Section 132 and 133 tax relief
Tax relief in respect to income brought into Malaysia on which tax has already been charged in the country of origin which have Avoidance of Double Taxation Agreements with Malaysia

I was working, earning rupiah and paying indo taxes until 15 Jan 2019. I already declared my taxes to Indonesia for the 15 days in Jan 2019.

What is "income brought into Malaysia"? I moved alot of my saved salary to Malaysia during the period of Dec 2018 to April 2019 from my Indo Bank to My Bank.
Why is there Tax relief if it is not taxable in Malaysia in the first place? Do I have to declare it? I called LDHN many years ago and they confirmed I did not have to declare anything.
it is called tax relief due to no taxation by the malaysian government for malaysian working, earning and bring back money into malaysia, where his earning originated in countries that has  Avoidance of Double Taxation Agreements with Malaysia. That Malaysian is "Tax relief ed" from paying further taxes in malaysia for his earning are already being taxed in that country where he earned that money. That is why they confirmed you did not have to declare anything.

Thanks!

QUOTE(moodycow @ Jul 3 2020, 09:29 PM)
Hi all,

With the Covid-19 already affecting my livelihood, last week, there is this letter from LHDN asking me to visit lhdn with these documents:

1. Income documents:
EA form
rental statement

2. Tax Rebates claimed documents:
Child school
Lifestyle claim
Life insurance and KWSP
Medical Insurance

3. Audit Asset Acquired more than 10 years ago:
S&P
Loan Agreement
Explain how to get the fund to buy initially, and pay installment.

I have some questions, hope someone can shed some lights:

Can I explain to them about my situation, whereby My parents have been renting house all these years, and they have chip in for the down payment, and installment subsequently. They also have income of about RM2k and RM3k during the property purchase, and do not have any mortgage & hire purchase under their name, they usually save money, so they have savings all these while, bought some shares and also profited from it, as they are 60+ already and hard to get any loan. With the combined income of myself, and parents, it is about RM8k per month, installment is about RM5k. But for document to proof that they supported me for downpayment, I really don't have any, especially it has been more than 10 years already...

The problem is, I do not have any document to show that my parents supported me on the downpayment, As I though by law, we are expected to keep document for maximum 7 years only.... they are asking for more than 10 years ago. Will it be okay to tell them my situation, whereby my parents supported my downpayment, installment, and in fact staying with me, but I do not have the proof now leh, how is it possible to keep document for so long.... will I be in trouble with the above letter from LHDN?

Hope someone can help, I am really lost here and having many sleepless nights...
*
just asking,
how much is the downpayment for that purchase?
is there any proof of income by your parents as per mentioned?
any transaction records as per the earnings from shares? (how much did they make from shares?)

Hi yklooi,

Thanks for asking. The down payment for the purchase was about 40k and 50k for another property 2 years later.
(but you mentioned bank repayment is RM5k pm...thus normally DP is 10% of value, thus 2 house prices abt 900k combined? at 10 yrs ago, how can you afford to get loan approved if your salary is not high enough?  hmm.gif  hmm.gif  )

Proof of income, means the income tax submission to LHDN? or salary slip?
something like lhdn, epf statements....most probably can still get details from them.

There is no transaction record that were kept anymore, as it has been more than 10 years, and hence they didnt keep anymore. Over the past few years, the profit from shares  were at least 40-50k.
this profits details can still get from the brokerage firm (i think) or bank statement records

Any idea/suggestion would be much appreciated....

Hey guys, wanna check, i just sign up for zerolution maxis for iPhone. How do i claim income tax next year? Since they don't give you a receipt for that, more like together with monthly phone bill. I do have the advanced payment receipt, but its not indicated that it's a phone, the item is "zerolution advanced payment".
*
hmm.gif since the phone did not have a "proof" of a specific value,...how much do you want to claim?

QUOTE(MUM @ Aug 12 2020, 05:19 PM)
after the audit and explanation given, if it is not justifiable, then they will seek to do fine/penalty right?
but now TS, tiba tiba kena penalty without any audit or interviews being made by LHDN  confused.gif
some more 2x the property value  sweat.gif  sweat.gif
*
that 2x of property value "could be" just a coincident numbers between the penalty and the property price.

(my imaginative scenario)
for before 2005, TS had been making alot of money and dutifully and diligently had been paying taxes for many years.
while during that time, he saved and invested those money.
The money saved can be enough to sustain him for whole life with alot to spare too.
Thus 5 yrs after he stopped working, he decided to buy a property (in 2010) with some of those money.

i think like jiaen0509 mentioned, LHDN maybe wondering how TS sustain his living expenses.
he did not declare income tax since 2005, he must have income to sustain himself.
thus if they really need to know.....they should have call TS for some audits/interviews to learn about that.

but TS got no audit/interview, but got penalty, thus i think it is most likely, that penalty is for the non submission of tax reporting issue

Hmmm, but I think their case is they've cooked the books, i.e: those workers don't even exist, and no transactions were conducted. In my case, my wife do exist, I do pay her and record every transaction.

according to this...

Simply enough, a ghost employee is someone on the payroll who doesn't actually work for a victim company.
Through the falsification of personnel or payroll records a fraudster causes paychecks to be generated to a ghost.
The fraudster or an accomplice then converts these paychecks.
The ghost employee may be a fictitious person or a real individual who simply doesn't work for the victim employer.
When the ghost is a real person, it's often a friend or relative of the perpetrator.

In order for a ghost-employee scheme to work, four things must happen:
(1) the ghost must be added to the payroll,
(2) timekeeping and wage rate information must be collected,
(3) a paycheck must be issued to the ghost, and
(4) the check must be delivered to the perpetrator or an accomplice.

https://www.fraud-magazine.com/article.aspx?id=4294968370

Payroll Fraud in Malaysia
Payroll fraud, as the name implies, is the theft of funds from a business via the payroll system.
It is a form of asset misappropriation and one of the most common types of fraud in businesses.
Precisely speaking, payroll fraud can be defined as the unauthorised altering of payroll where the person (an employee) committed the fraud could make financial gain.

What is Payroll Fraud?
Payroll Fraud in Malaysia
In general, employees can commit payroll fraud in several ways.

1. Ghost Employees
One of the common ways behind the payroll fraud is the existence of ghost employee. Ghost employee is the fictitious identity created by the dishonest employee, recorded on the payroll system, but does not work for the business. The fraud happened when the salary is paid to the false employee and the dishonest employee will then collect the fund.
https://www.3ecpa.com.my/blog/payroll-fraud-malaysia/

but for your case,...i don't have the figures...i think MANY MANY people is doing it,...some even do it with their properties...(paying high rentals to their own or relative's properties)

Hi guys,

do we need to submit any letter or form (i.e. Form CP22A) to inform LHDN if the employee had cease employment?

The employee will not leave Malaysia or anything (He still paid for MTD in other company). It is just that the employer would no longer pay for his MTD ~ Company become dormant.
*
How do you know that the ex employee will not leave Malaysia n will continue to pay mtd?
