Q: Are kindergarten fees eligible for claiming personal tax relief?

A:Yes, the kindergarten fees are eligible for claiming personal tax relief if the following conditions are met:
(i) fees are paid to a kindergarten registered with the Ministry of Education Malaysia; and
(ii) for a child aged 6 years and below.

Q: Ken has purchased a new laptop amounting RM 4,000 for personal use on 10 August 2020 and there is only one receipt. In his income tax return for Year of Assessment 2020, can he claim RM 1,500 under lifestyle relief and RM 2,500 under the special additional lifestyle relief for the purchase of smartphone/tablet/personal computer?

A: Yes, he can maximise the relief claim by splitting the laptop cost under 2 reliefs in his income tax return for Year of Assessment 2020 as he has met the criteria for the special additional lifestyle relief (up to RM 2,500):

Purchase of personal computer, smartphone or tablet for self, spouse or child use/benefit and not for business use; and
Purchase was made during the period between 1 June 2020 to 31 December 2020.

my take, (which can be wrong), is the spouse working? if yes, then most probably cannot.

more of those ambiguous tax relief items..
Medical expenses on serious diseases for self, spouse or child - (Name on receipts may not be of the tax payer, thus need to show marriage/birth cert to confirm relation?)

Insurance premiums in respect of education or medical benefits for an individual, husband, wife, or child.  - (applicable only if name of tax payer to be policy owner?)


Just need a confirmation from another person to play it safe. (better to confirm not just with another person but direct with LHDNbrows.gif

Another scenario: Possible to claim it using a receipt that is under my brother's name? He did not claim it in his personal tax filing...But I have the physical copy of receipt under his name....

Can I claim? Most probably not,...but can "argue with /explain to" the officer if/when audited ...if cannot then pay back with some penalty only.... have to calculates the possible amount of penalty to determine if it is worth to gamble considering the probability of being audited (higher chances of being audited if you have not being audited for the past 5 yrs and lesser chances of being audited again if you had just being audited in the last 3 yrs)  biggrin.gif   innocent.gif

some decades ago,... a machine of my employer has breakdown.
the company that do the repairs quoted him RM30k
then later that day, a regular service man of that service company came over to says that he can do it for just RM10k...
my boss, agreed and that serviceman monnlighted for a few days and replaced some faulty parts,..machine runs ok then.
My boss transfered the payment to that service man bank a/c....
and then recorded in the company financial transaction records...

thus i think LHDN will know who received that payment
the serviceman, if he records that 10K income in his Form BE as other income,...will he loss out considering that he used some of that money to buy stuffs?
if he had used form B, will he allowed to minus those "business" expenses??

Since you are still waiting for feedback.
I kaypoh abit if for me,..... I would (which may not be 100% correct or effective)
Print out my previously submitted BE form,
Labelled it with "borang BE yang dahulunya telah Di hantar" at the top.
Highlight the area that was errorly submitted and remarks it as "infomasi tersalah lapurkan"

Print out a new BE form and fill in the correct data.
Label with pencil at the top page "matlumat terkini yang telah dikemaskini"
Fill in the required info (as per new submission),
Attach supporting documents
In the form can do summary of tax amount to be paid or no need to pay.
Sign the form.
Attach with a written letter addressing to them, describing & explaining the issue.

"Tuan adalah dinasihatkan untuk mengemukakan permohonan pindaan melalui surat permohonan pindaan dengan menyatakan alasan-alasan terperinci berkaitan dengan permohonan tersebut beserta dokumen sokongan"

Try this? Selext the year, (stated,... go for malay version)

Worst case,...
Maybe can you use back your previous BE but just "liquid paper" to cover and amend the "error" data then photocopy it!... Photo copy would cover up the present of "liquid paper"
