I think the root question is "If it is a public area, why the area can be fenced up?"
Nevertheless, with the approval from Majlis Perbandaran to set up the fencing / Court case that legalize the guard house and boom gate, these all are actually acts of "privatization". I think there is already a mindset shift about this matter, subconsciously.
Yes, from legal term, the garden / amenities / road within a FnG presint is public, but in daily practical, from my perception it is already privatized.
When an area is already fenced up, if public want to go in, definately the guard will not allow. Yes, one can challenge it is public place, why he/she is not allowed to go in. But in reality, it is no logic for a public to spend time, money, effort to lodge a court case just because he/she wants to go into this area to "makan angin". Even there is a garden a park inside, will he/she so desperate until want to file a court case?
The most probable person that will strongly against this most likely would be the house owner in this area, coz he/she has a house within the fenced up area and he/she got problem to access it due to his/her ignorance in paying the maintenance fees. But, apparently, the recent court case shows that guard house and boom gate is legalized. This will give impact to the subsequent owner who intend to do so, coz maybe they will lose the court case and lost great amount of money.
In conclusion, for Fng housing, legally road/garden/amenities are considered public, however, based on the action by the Majlis Perbandaran and the court, it seems like already privatized subconsciously..
