Sorry, first time tax payer.

Just wanna know, if I am a Director of a company, do I fill in the eB form or the eBE?

Ie. do I fill in the one which says 'ada punca perniagaan' or not?

Q1: Who needs to furnish Form B?
A1: Form B needs to be furnished by an individual who is resident in Malaysia and carries on a business.

Q2: What is the difference between Form BE and Form B?
A2: BE Form - income assessed under Section 4 (b) - 4 (f) of the Income Tax Act 1967 (ITA 1967) and be completed by individual residents who have income other than business.
Form B - income assessed under Section 4 (a) - 4 (f) of the ITA 1967 and be completed by individual residents who have business income (sole proprietorship) or partnership.

Q33: If I started a sole proprietorship in 2010 and I was a director of a private limited company, do I fill out two separate forms for reporting these two sources of income?
A33: You are not required to fill in two different forms. You just need to complete Form B 2010 because you have business income in the year 2010. Statutory business income should be reported in column C1 while income from employment as a director to be reported in column C10.

Dear All

Question,

My Diploma course fee is RM8900, made a cash payment RM2500 in the year 2012. Balance payment will be paid tru EPF withdraw.

Can I claim for RM3900 this year and the balance RM5000(since that is the max amount) next year? Or

I can only claim RM2500 and I cant claim the epf withdraw?

note: I havent make the withdrawal yet.

BTW, just to clarify, slow talk to waive is to waive penalty only. What ever mistake(over claim) or you owe them money, you still need to pay.

if I earned less than 17k and no income tax has been deducted in 2013, do I have to fill in the BE_2013 form, which will due on 30th APR 2014?

By theory, no need.
But if you are going to take a loan, is better you open an account.
Is quite easy to get the pin from their office.
By declaring your income, it is the best method to prove that you have income when you are taking loan, applying for credit cards.

If you have a tax income file opened, just file it even though your income is not taxable.

I’m a legal tax payer. However, I never look as submitting forms is important every year because to what I understand, since my payslip had deducted the amount of tax to the govt. it should be fine. Like what is there to declare if I did not owe government anything? So I was totally wrong about it and misunderstood. I even misunderstood the EPF and tax part. My colleagues do make noise everytime submitting tax, and the impression they gave me they just wanna claim some money back. To me, I am fine, it's better the govt. had the money from me than I owe them plus I really hate paperwork. You may ask why my HR/Admin never brief or at least tell me? I do not want to put the blame to my HR/Admins though I’ve asked some several people that they do have responsible to at least explain the importance of submitting tax forms every year when my salary had reach the certain tax amount.

Now after I acknowledged the importance I am actually gathering all my EA forms and other documents to file to the tax. I checked with Hasil and my Tax No. also existed (my tax no. never appear in my EA form because it's under pending but they still receive tax from my earning every year). And I just registered to e-filing. So my questions is that according to my pay I should have start submitting my tax forms since 2009 but I did not do that. If I plan to do it and submit it now, will I go to jail? I am not even doing a full time job anymore and trying to do my own business but I've decided it's better I do my tax now since it's important.

Should I really go ahead submitting my tax? The fine is RM200 (min) to RM2,000 (max) or spend some time squatting in prison (not exceeding 6 months). I've calculated that from my tax I might can redeem from 700-a thousand every yr. If it's penalty judge by every year I guess I need to really eat wind. I don't plan to buy any property in this few years though.

@J_pandapuppet, you can put back-dated incomes from previous years at first page under "Pendapatan Tahun Kebelakangan Yang Belum Dilaporkan".

Since you have actually paid the tax via monthly PCB deduction and if you don't have any business income, I don't see the big deal. In the case of being audited, you can bring along the previous EA forms to support your case.

if you have tax file number , please submit your tax until IRB send you a love letter notify you no need to send.
