U can ask for RM1500, plus the early termination fee required, or in lieu of that fee, waive the termination cost to you. Ask for that, in addition to the RM 1500 you paid for the phone.

Hi. Your seller is digi? You won the case?

Yesterday I went for hearing too. My seller, Digi came to represent. Although I won the case, but the judge only awarded a repair within 14 days. I was expecting a 1 to 1 replacement but then...sigh.

Anyway, the reason the judge not granting a replacement because he looked through the warranty statement comes with the phone in the box, and found out there's no clause on replacement. This judge played by the book and wants black & white.

14 days... so I'll keep my finger crossed.

This is reason why I dont using HTC ONE and later file for Tribunal Consumer Court, as it depends on the Judge who are In Charge for Final Verdict. Some of them MAY award for refund and some will follow by the book rule..

If follow the book...there's no one to one replacement.
Rosak..send for free repair.
Six times go repair still rosak..go Tribunal
Ask the Judge ...want to repair how many times till it deems unrepairable and can ask for refunds..?

It is better not to have this set at all rather than have it and face alot issue of this kind hassle.. How many times to get repaired and still not properly done, go tribunal and then the judge award to get it repair again.. This all time consuming and waste time, ( This is my opinion only)

I wont the case because:

1. Digi staff not attend
2. I did send for repair for 5 times, since sep to end of jan and still camera issue. This show to tribunal claim how I co-operate with them, but HTC fail to solve it. Especially I mention during this period almost 4 months no phone to use

Next time if got case then u don't bring the warranty book, just show them the phone...

u cannot ask the judge like that, it become no respect to him, no benefit for judgement. u just ask the seller in front of the judge.

after I win the case, I still look for new batch htc one, which is sure no camera issue. Am I crazy? rclxub.gif

to win the case, u must show the judge u have co-operate send for repair but they fail to solve and waste a lot of times. Then judge will know repair no good solution and will protect consumer right ask for refund.

I'm glad I brought the book. Because he asked for it. He wants to know what the warranty stated.

But then, the award is still favourable to me. If they fail to repair within 14 days, they will have to pay RM5k penalty to the court. I highly doubt HTC service center can comply. By then, I guess the solution would be they replace me a new phone for out-of-court settlement.

On the other hand, if they managed to repair it, I can get back my phone in less than 14 days, which is also a good news. rclxms.gif

U no need bring the book, it is seller responsibility to show the judge what their warranty it. Kick the ball to them. Buyer no need proof what warranty is. If seller not bring the book, sure u win the case.

To an extent, the judge asked me how I know this phone has warranty. He wants everything black and white. There were a few hearings which he denied because of lack of documentations.

I guess it very much depends on the judge.

U know got some people face problem when replace with new set? u can study foreign website and see what their complaint. replace new still problem. then need start send repair centre again. Crazy.... vmad.gif

Especially go to Taiwan website mobile01, but all in Chinese word. U will find out what I mean.....

Unless they give u new batch manufactured after nov.....no complaint anymore

Yes, I know the problem. The reason I want new because I can sell off easily. Not going to use HTC anymore. Lousy.. HTC = here's to change.. And I have changed to S****** biggrin.gif

Just answer when buy the phone u did ask this phone got warranty or not. Normally seller answer yes. According to business law, verbal promise also is contract. So let the judge ask them lo. Kick the ball to seller.

I feel u meet the judge which no really protect consumer, it is seller responsibility to provide info to judge. Why now become yr responsibility.

Nvm.. it has passed.

Now Digi faced at least 2 court orders. Is there any more? If there is, it's a good news. This can send a message to them on the lousiness of HTC. They may consider twice whether to sell HTC in future or not. As time goes by, then HTC can follow the footsteps of Nokia.

better take back yr money if they cannot solve yr problem. Make second complaint to tribunal ...

when do sell u know need give discount...sigh. In kl red set is selling RM1659 with one year warranty. New set replacement u get is follow yr old set warranty period, mean u get few months for warranty only. So who buy from u will meet short warranty problem.

At least it is better than used set. Anyway, getting this phone is already a loss in the first place. Nothing can be done. Just hope I won't encounter same problem with my current new brand.
