Item being sold/bought: iphone 5 16gb

Date of transaction: 20/12/2013 (sunday) *noted that all this happen in OCTOBER* typo and I HAVE ALL THE PROOF !

Details of the complaint :
-before the day we COD , he keep on asking me to deposit half of the price of RM1750 into his bank account (i refused and said i wan to face to face to deal)
-he know i'm wise , then he say when cod i must handle him RM800 for him before i can check for the iphone 5 (i deny again)
-I deal with this scammer on 20/12/13 face to face at my place here
-everything is okay during the COD until the time i ask for my free casing, he keep on asking me go to his car (but i refuse too)
-everything runs smooth after that he went home
-BUT ! when it's around 12am on 21/12/13(mon) , my Iphone 5 had been erased and been lost AND IT"S REQUIRE APPLE ID to activate it.......
-I phone his no. until my phone overheat he no picked up but luckily the next day he call back
-Since he said that this phone is his self-owned , I asked for the APPLE ID to activate ,who knows that ID is just a piece of shty useless ID (cant activate) using "find my iphone" apps
-He say his friend is a hacker and can hack the ID with password for me , wanna scam another Rm350 from me (we keep bargain for the price as i'm sad with the phone now jz a useless brick apple iphone 5
-my friend is a pro-online shopper he then picked up my phone and bargain till Rm100....
-after that he keep on emphasising me to post my IPHONE 5 to his address for the unlock purpose (I'm clever for that and REFUSE IT !)
-so he wan me to bank in RM50 and i did it, then i noticed that he erase the iphone from the "joseph.wong63@hotmail.com" .....can use again
-but after that he keep on threaten me to bank in RM100++ into his account until now he keep on kacau me
PS: As I ask the maxis dealer with the IMEI no., the phone warranty is until june 2015 , it follow the contract he sign and will be terminate if discontinue the contract and when claiming for warranty the owner must be present (Honestly speaking when the time u deal with me u say tat the apple warranty is until september 2014 instead of december 2013, who noe it will change and follow the warranty as old warranty ? u should speak it out clearly and properly about the warranty. Ask the kakak or abang there what to so next.
They are very kind to help you out.
If you had a lawyer friend, tell him/her about your case.

What happen to ur eye?

In contract law, the thing you sell are supposed fit the purpose of what the buyer intended to be. Seeing how the phone got brick and buyer is requested to bank in another rm100 to your account for unlock purpose, and also the other buyer(s) complain against you...

One more thing about the defamation suits you filed, if this situation is brought in by defendant... it would really put lots of doubt on your reputation in the case.

you could dare as much as you want and in terms of law he can't do anything as he already got the phone, but in terms of reputations... you just got toasted.

On the COD day, I do go apple warranty site and key in the phone serial number and let him check the warranty. The warranty till Sept 2014 as mentioned by me. I still hve the print screen. I do let him check everything and he agree. Now he deny. If he insists just made a report that I sell him stolen phone. See what police says

konakona The noise is because kwk_1995 reduced the image quality for faster loading.

I tried doing it myself, the warranty information is same like what kwk_1995 posted.

So kwk_1995 wei988 I would recommend you both take a pictures with the warranty screen with some info in it:

1. the time and date.
2. a piece of paper with your lawyat ID on it.

Telephone support only for the 1st 90 days from purchase.
Parts warranty is from 1 year.

My clarification

I've checked with Apple. Since this is a new replacement set, the warranty at first sure will follow the new activation date. However after months, they will update to original warranty date which as shown.


However, my set is telco set and it's running 2 years contract. So the warranty will follow telco contract warranty. It means that the warranty will end once my contract end which is June 2015 ( I buy my 5 with maxis contract extension)

According to apple staff, even you have warranty with apple, but when comes to anything, we still need to bring back maxis.

If the TS dis happy, he can always meet me at maxis centre to clarify this

Maxis does not entertain 3rd party buyer.
The warranty stick to the purchaser contract.

Meaning if the phone is faulty during the 2nd year, Maxis only entertain if the real owner of the account holder shows up.

We just assume that you deal with him on 20th Oct but why u only lodge a complaint after four days since you're so unhappy with the deal. If I'm you, I will make a complaint on the next day, but not wait so many days since this is quiet serious and involve scamming issue

From your ID, I assume that you're 18 years old. Why a 18 years old boy so easy to forget date? This is a very important stuff leh, the date is not to be mistaken. If I on your side, I'm sure remember the date very carefully. But as claimed by you, you say is typing error but logically a typing error won't be repeated for three times. At the laptop, tablet keyboard, the 2 and 0 is kinda far away. Use a common sense to think also know the chance of being typing error is quite low

it's my fault on the date anyway, becoz of the warranty keep on coming in my mind that it's now december it's december....I'm with maxis and pending now as stated, the joseph.wong63@hotmail.com email is roughly like that since it lock my phone and back to activate mode so i wont have another clear look on it properly after it turns black and come out the reactivation of iphone on start up. I'm okay with the price so i deal with him but he's asking me to bank-in unwanted money for the activation fee.

even though i'm not sure abt the email tat used to activate the iphone, he has the "trick" to know and hack into the account and remove my iphone from the icloud.....don u thk something weird behind it ?

We assume that you make the date wrong but you din mentioned at your complaint that the warranty has ended since u says that you deal on December. Regarding the email u mentioned, it can't be roughly like this. If u want lodge a complaint, you must make everything clear and strong evidence. Since the email also unregistered, I wonder how the seller activates the Apple ID.

Hi dupe are you Eric? Eric if you are reading this, just unlock the phone for TS and get over with it. You restored the phone on the spot, and TS didn't unlock it on the spot before paying you. Thus the misunderstanding. IOS 7 has this activation lock thing, where you have to disable iCloud before restoring it, else you will need to login into your iCloud again. Both the seller and buyer might not know about this, and it's understandable. You as the seller, should make sure the phone is unlocked before selling it. Else you are selling a locked phone which is worthless.

the phone is owned by him therefore starting it's not a scam case coz i phone him telling tat my phone is lock at the activation there.
