Of course with MCMC, I would explain that the speeds I'm getting ain't even as advertised. I have kept all the download speed history and email log in case if they needed material for investigation. Therefore if I have to pay RM500 penalty, I wouldn't need to approach MCMC at the first place. 

I would consult from CFM / MCMC that the provider isn't providing speed as advertise and even in fact unreliable and unstable. I'm not even using P2P, therefore the fair usage policy shouldn't affect my HTTP download. Heck even YouTube streaming is bad.

There's no conspiracy theory, whitelisting or throttling.

You can't prove that something doesn't exist. It's a logical fallacy. You have to prove that something exists before you can conclude that its negative doesn't. In other words, if you think your connection is artificially slowed down, prove it.

The only throttling I'm aware of is the 10Mbps down and 2Mbps up (for the 10MBps package). If you think ABN is purposely slowing your connection down (and not mine -I can attest that), prove it or quit whining.
I use my ABN connection for work. All day facing a computer, the last thing I want to do after work is to get online more.

100% deserved. It's not like p2p software users are doing anything legitimate with it in the first place anyway. So no ground to argue. Or maybe you can fill up a complain to MCMC and tell how nasty ABN is preventing you from illegally downloading copyrighted work you were too cheap to pay for. I'm sure they'll be thrilled.
