Exactly, not even harsh military dictatorships like Burma or China. BTW what happened to Genneva's business in China? If the Chinese Government finds that a goldco is running a massive ponzi scheme and cheating their people, they will line up the directors against a wall and shoot them by a firing squad.

It's just a rumour. BNM has mentioned in its FAQ that all seized assets can only be released at the discretion of the courts, not by Najib.

All the argument about the use of the word 'approximate' and doubts about the amount of gold seized and what was declared by BNM, etc, It is a requirement under BAFIA that all properties seized under BAFIA or AMLA should be accurately recorded AND CHECKED AND COUNTERSIGNED BY THE PARTIES OR OWNERS OF THE SEIZED ITEMS. Meaning the management of Genneva have counter checked the gold seized that day and can verify and make a press statement to that effect if they want to instead of maintaining their elegant silence. Heres an excerpt by Dee Casey on GMS posting which is actually quite accurate.

"However, according to the rules and procedures of seizures conducted by any authority, especially in this case involving the police, there must be a statement for a list of items seized from the premises of a raid and that statement/list should be signed by an appropriately ranked raiding officer and counter-signed by the occupier of the premises that got raided who must be also physically present when the items were taken away from the scene. There certainly will be documentary evidence as to how much gold was removed from Genneva's premises and this cannot be disputed by BNM nor Genneva. Further more, bigger gold bars of 1kg will have serial numbers clearly marked on them and these are traceable and identifiable. Similarly, monies in the bank account is traceable and BNM should have no problem identifying who paid what. So folks, these are facts that can be easily established by the courts since they have vast powers to compel any party to submit relevant documents for inspection and verification by all parties in the court action.

(So folks, this is not a raid on a durian seller by DBKL Direktorat where after the raid these DBKL flers have a nice durian party. Every item seized is accounted for and there is documentary evidence, counter checked and signed by the owner itself.)

Dee Casey: Dear Yvonne Chong. your suggestion will work wonders under ordinary circumstances say if you are fighting for a cause such as Bersih. But under the circumstance as you have mentioned, to protest in front of BNM when an international forum is in progress may not be a good idea as it may result in a backlash against us instead. The reason I say this is because Genneva Malaysia and Genneva Supporters are all legitimate people engaging/pursuing legitimate business. We want to continue to portray this image even if there is a court action instituted later. The last thing we want to be seen or labelled in international news as peopled involved in "an illegal scam" threatening the government like little children whose hand was caught in the candy jar. Please understand that there is a right time to do the right thing. I understand we are all desperate but not desperate enough to jump into something and make things worse than it is now. An update on last night's consultant meeting from a posting on GMS:

Arokiasamy Andrew: i will like to share to consultant meeting, the so call guy who was sharing the meeting with all the consultant like pasar malam, we have to sack him......giving us options that to sell the gold, where to sell the gold, all bullshit, please you can be a senior consultant, but respect us........today meeting is all nonsense.

(Talks about reselling of gold indicating that even senior consultants have resigned to the fact that GM will NEVER resume operations again. Are they slowly beginning to see the light??)

By now I'm sure many of the senior consultants MUST have realized that the directors/management have utterly betrayed them with lies and false promises and all the bull shit 'good news' week after week just to buy time. If anyone still believes in J. Cow then they must really be that namesake. From the postings, it is obvious that they expect the directors to be charged. The issue is the right timing to make the police report - should it be now or after the directors are charged? If the directors are willing to plea bargain then it might take a shorter time for them to recover the gold. If the directors and management still insists that they are legitimate and innocent, the case may drag to more than 5 years. Whichever way, a police report is essential for those whose assets were frozen to MAKE THIRD PARTY CLAIMS after the court proceedings are over. So to me it does not matter when the police report is made, the earlier the better. However all the necessary original documents must be in the possession of the investor. cool2.gif
