This is exactly what we have been saying all along. One can be charged for making a false report and here we have Pat Lulu urging people in droves to make police reports against BNM while she sits back and eat popcorn. She is really leading the GMS sheep to the slaughter and these sheeple can fall for it. Bank Negara raided GMSB so GMSB is the direct party that should make the police report or have the locus standi to take legal action against BNM. At the moment they are maintaining their disgusting silence and paying Lulu to incite and instigate.

The investors are merely THIRD PARTY to this episode. Get it, Lulu & Dee Casey!!! Investors, for heaven's sake, don't listen to these loyar buruks or you'll get yourself in deep shit. YOU CAN MAKE A REPORT AGAINST GENNEVA BUT NOT BANK NEGARA!!

Kenneth Brunt: Technically, BNM did not take our gold and money, but Genneva's gold and money. On what basis do we make police report against BNM? Unless the gold/money had already been given to us, and as we are walking out of Genneva office that day, BNM came and took it away from us. Then, we have a case. In other words, if robbers rob Genneva office of its gold, can we say that the robbers took the customer's gold? So, if we want to make police report against BNM, on what legal basis do we have the right to do so, Dee Casey?

I totally agree. The GMS page is actually extremely negative spewing hatred and resentment, libel and slander and inciting and instigating investors to go against the authorities. I also feel it should be SHUT DOWN immediately before some unfortunate incident happens. The admin always claims that ppl who make comments not in line with theirs, as fools, mean spirited and very negative but brother they should take a long hard look at themselves. Perhaps those people and authorities they slander should make a police report against the admin and some of these hostile commentators and let the police investigate. Facebook should also be reported for this webpage has the potential to incite hatred and violence.

Please read the posting carefully. He NEVER claimed that I have a fake account. Furthermore he was just being sacarstic and hitting out at GMS in a subtle way. And if you were to read earlier postings, we were actually discussing about alter egos on GMS not LYN. FYI I don't have to 'explain myself' to you.

Casey was partially correct when he mentioned about the 90 day period. Section 44 (5) of AMLATFA reads:

44 (5) An order made under subsection (1) shall cease to have effect after ninety days from the date of the order, if the person against whom the order was made has not been charged with an offence under this Act or a terrorism financing offence, as the case may be.

Note: The order will ceased to have any effect if the perpetrators are NOT CHARGED after ninety (90) days after the order was made.

However the property may be subjected to forfeiture even where there is no prosecution. Section 56(1) of AMLATFA states that:

(1) Subject to section 61, where in respect of any property frozen or seized under this Act there is no prosecution or conviction for an offence under subsection 4(1) or a terrorism financing offence, the Public Prosecutor may, before the expiration of twelve months from the date of the freeze or seizure, apply to a judge of the High Court for an order of forfeiture of that property if he is satisfied that such property had been obtained as a result of or in connection with an offence under subsection 4(1) or a terrorism financing offence, as the case may be, or is terrorist property.

Note: This section relates to the instance where the properties are frozen or seized but there is no prosecution or conviction of anybody. The Public Prosecutor (PP) may, before the expiry of 12 months from the date of the freeze or seizure, apply to the court to forfeit the properties if he is satisfied that the properties have been illegally obtained as a result of an offence under section 4(1). However if at the expiration of the 12 months period, no application is made by the PP, the seized property will be released back to the accused.

This act of forfeiture has happened before as in the Gold Label case:

BNM’s completed investigations then led to a court action in 2011 where the government filed for a civil forfeiture under Section 56(1) of AMLATFA at the Kuala Lumpur High Court. The Gold Label directors were not charged even before the lapse of 12 months after seizure.

Casey's focus was ONLY on Section 44 (5) of AMLATFA. He failed to mention that the Directors of present Genneva are also investigated under subsection 25(1) Banking and Financial Institutions Act 1989 (BAFIA) i.e. illegal deposit taking. BAFIA as far as I know does NOT impose any deadlines as to the period of investigation. Therefore BNM basically can drag their investigation much longer than the 90 day limit as touted by Dee Casey under the vast powers of BOTH BAFIA and AMLATFA.

It's better this way. They will never accept BNM's investigative findings even though it may be objective and done professionally. Even now Shereen is screaming that 'sustainability' is NOT the issue. They are really afraid that audit findings from both KPMG and PwH will show that liabilities far, far exceeds assets proving that Genneva is a ponzi scheme that is not sustainable and directors have transferred huge amounts of assets overseas. Anyway what is sure is that investors will NOT be able to claim the full amount they lost upon completion of the judicial process which may take a while.

I'm glad that Donald Lim has given some assurance that investigation will be completed some time this month. It won't be a Happy Chinese New Year for many though....the snakes had their way but will be nabbed as they attempt to slither away. It will not be their Year for this bunch of Snakes in Kuchai Lama.

Dee is just stalling. He's the one who was pushing and suggesting that GMS folks make the police report. I don't think Dee Casey is a lawyer. He may be a paralegal or just a clerk in a law firm and pretending/claiming that he is a lawyer. That 90 day farce and rejection of police reports was indeed a big slap on his face. He also appears to be telling half/quarter truths and make it seems like its the whole truth, thus hoodwinking even the GMS sheep. Of course Lulu who knows next to nothing about law just follow him like a dumbo.

I have strong reasons to believe that he is NOT a qualified lawyer at all, just a pretender and a FAKE. Why??

1. His legal advice are all unsound. Almost all lawyers I spoke to or read from postings said that investors have a weak case against BNM because the agreement is between the investor and Genneva and they have no locus standi to sue BNM. Now he comes out with some grand idea about a judicial review against BNM and until today has come out with nothing.

2. His call for 60,000 investors to make a police report against BNM is a dud. He himself has not made any and those who tried can tell you how futile this is and were warned against making a false report. When confronted he gives lame excuses and ask people to follow the pace. Where is the so call 'perfect' format/template police report that he promised??

3. Genneva is under investigation for a host of offences ie from illegal deposit taking, money laundering, improper documents, hiring agents without licence, tax avoidance, fraud etc....but Casey only focus on money laundering (Sec. 44(5) AMLATFA) ie the infamous 90 day period of his. A good professional lawyer would cover all areas and would NOT spew half truths focusing only on money laundering and the 90 day period. His credibility went down the drain after nothing happened after the 90-day period.

4. If one were to read his postings on GMS, he appears to be a rude, arrogant moron with a superiority complex. The way he handles himself is certainly NOT befitting of a professional lawyer.
