Hi all

Yesterday i made a. Police report against courts mammoth and their panel lawyer or maybe debt collector. How can i do that? Any lawyer here?

Here is my situation.

I paid full payment of the outstanding on courts mammoth on 9.8.12 but then 3.9.12 a so called lawyer saying his name is haji salleh, later called my pengarah and head of department that they gonna sue me of not paying the outstanding. Later my pengarah asked my bosses to check what happened. Seems every head knows about it. Now, i want to sue them for causing defamation on me. I have all the receipt even checked with courts that my outstanding is 0. Its the debt collector (not sure hes a lawyer or not). Any advise?

This is a pretty good case if there aren't any disclaimers. Contact a lawyer and see how it goes, but first look through the contract and see if there are any disclaimers.

Hmm.. I dont have any contract copy but i do have the full settlement receipt. I already malu when all the head looking at my case and thought i never pay thats y saman. But its unethical or them to go after my bosses. If i owe them find me not my company.and in his case i already paid,.

they can come back and say the data not updated, then you need to pay for your lawyer fees.

A lot of situation is like this whether you want to "play" the games or not.

Oh please sue these people. Sometimes they're not even under the main company (courts mamoth etc.) since i once kena.

Some kapchai tamil gangnam gangsta with 3 fella frens go tahan me. Say i havent paid my car. Then i said i paid already. I was late but didnt exceed 2 months..they said exceed 3 months..the bank sent them. So i said lets go to the bank where it was just 2 blocks away. they say cannot cannot and ask me talk on phone to their kepala or boss or something. Then i talk to the guy..he say just pay his guys how much i have..I was like wtf for but because i was having lunch near my office i malu edi so gave rm50. so they went off. I was SO embarrassed. So the next day when i was calmer i went to the bank and check with them(basically wanted to go there and tiau them) but they say they never report anything. After a while i do research...their workers might have supplied inside bank information to outsiders. Which i right now think couldve sued them for it. But i didnt have any known(frens) with me at the time. Bastards these fellaz and who ever work with them.

If data not updated, its not my fault tho. The thing is they already memalukan me the whole department. Im sueing them for defamation only.

Lots of companies do this, they normally just pass those files over to a debt collector and/or a lawyer and these people will get commission for any debt collected. That's why they are so persistent.

My company has similar case with Telekom Malaysia, they claim that I owe them this amount of money which I have never renew that particular plan and also they acknowledge my letter of cancellation. Worst thing is, this was cancelled way back in 2002 and recently they came and kacau again. They will always send a different lawyer or debt collector firm to threaten you, with lots of notice letters, warnings and phone calls made to all the staff of the company. They won't really sue you, they just threaten only. Lots of people shiver when they receive lawyer warning letter or hear that big companies wanna sue them.

Go directly to courts and demand for a clarification. Show all your receipts and keep every single letter. Write back to them in black and white with the prove and everything also. Chances are they will keep quiet for now, promise to update their accounts, pass you here and there from one person to another, andden after few years will come back and haunt you again if they lazy to update their accounts.

Don't think you can do much with a court case, lawyer fees not cheap these days. Your bosses should understand that this sort of things happen and you can always explain to them that it's the courts company that never update the accounts. If they really wanna make a big fuss about it, show them the receipts then. Embarrassment don't think can sue much, unless it's like you lost your job/business because of it. Anyway, try consulting a lawyer and see how it goes.

if you are in it to clear your name and not for money, write to malay mail. emphasize that you are caused huge distress and that your kemaluan amat besar because of their incompetence. if mm picks up on your letter and publishes it, it'll be in public for whole malaysia to see, then courts will probably write back in with an apology. then buy several copies of those MM, cut out the story and paste everywhere in your company's bulletin board.

Newspapers..good idea..u might want to review ur sentence with that sensitive word.

like my family case with GMC, their DR rude, customer service poor n scold client, we can't do anything, their legal team said : yes they rude, suck n scold ppl, but they don't make me losing anything, after consult with own legal, they said i can make good case but not worth for me, cause i get nothing back in return + GMC have legal team and i have to pay my legal fees
so just give up on it ...

I asked for official apology letter but then the customer service gave me an email add that doesnt exist. The email is not delivered according to gmail,sent back to me as the delivery failed. That makes me more angry that is y i was thinking of consulting a lawyer to clear my name. Sent a letter to thestar.com.my editor, will proceed with other newspaper.

sometimes u just need to look at life positively. look, your bosses knew u have this financial problem. u purchase from cheapskate company that give u this loan plan. nothing wrong at all . it's just that your salary doesn't pay u enough to buy stuff in full payment or in cash.

just learn the hard way, never get yourself into any plan like that with cheapskate company like Courts Mammoth in the first place. all my life, i never like to buy from this co .

not to mention the "admin charge", which they only tell you about after you decide to buy. and it's usually more than 200%, up to 300% in some cases.

lol, that's a simple bluff, man. the legal people have a way with words. first, they'll do anything not to go to court. by saying those words, they effectively won by discouraging u to NOT do so. and if your lawyer cant even fight against that simple bluff, u should fire him and get another.

i know this dirty tactic as it was used against me before. we complained to JPA bcoz they processed our scholarship wrongly, to one point we wanted to sue. and we had a good case against them. however, we didnt have any lawyers attached to us directly, just a family friend who gave us some basic advise. thing is, JPA people and their legal team easily convinced us it's not worth to pursue it.

so in the end, we just keep complaining (but didnt bring the matter to court) to the higher ups, and eventually managed to rectify the problem about a year after.

because they call your boss and reveal your financial situation which is basically trespassing.

Ask your Boss if he is going to Court to become your WITNESS. If not, u lose. waste of time and money...

u think so easy, money will be start rolling for u the moment u engage lawyer.. u want to win, proof that they call your boss.

is simple as i mention, sue for what ? for self ego or demand for compensate, even for 99% winning case but nothing in return other then hurting own pocket ? this is what lawyer never tell you .....

Their legal team can drag the case until u cant afford to pay your own legal cause they paid the fees already and we aint ...

there is more dirty trick they can play with you.

Ask for apology letter to make it easier.. The letter will prove that they did call up...

Good case there man. Defamation is there. Put in time wasted as well

not as easy as it sounds... might end up charged with more legal fees that the amount received from the sue itself.. plus if im right( IF here not saying this is right dont want people blasting me over this, I am NO EXPERT), defamation arent as straight fowards as it seems, there are requirements ie, have to be someone prominent and depends on how bad are you affected by the act as well, ie lost of income bla bla bla


Usually its the debt collector who over reacts over these things... deal directly with courts ( went through something similar with TM and i deal with TM directly instead of the debt collector)

defamation case easy 10 k ... But u can do it , for multiple cases, and the lost in reputation and mental trauma can push for 30 k

First, wrote to bank negara about this. Second find out if the guy calling your office from court mammoth or some screw up debt recovery agencies. If its court mammoth, go to their HQ and make some noise else if its collection agencies, then they cross the Bafia acts. In bafia acts if the bank or fi or credit company leaks your info to others, you may sue them. Penalty is RM 3 million or 3 years in jail. In your case, you got plenty of witnesses, go ahead and do whats right but make sure, make a police report first.

Lawyer fren not around.went outstation out of country .a forumer sent me a contact number of lawyer.if i still cant get them thru email for that damn official apology letter to be faxed to my office, i will call this lawyer. Their email cant get thru! All delivery failed. Dem

Same like AEONlah...i transferred money oledi (a few days back) yet they say never received. After a few minute later they said got oledi...

I think they have a KPI for such things. just wanna prove that they are doing their job

These are most likely the debt collection agency. Have you received any letters from them telling that you have not paid?
If you have, then you have the name of the people who called you.
I had the same problem with Celcom before. They sent my number to multiple debt agency company. They sent letters and etc. Well I dont know if they called the company or not cause I changed job. LOL!!
