this is bad for the consumer. what are the chances we can use touch screen phones similar to the popular Galaxy S3 in the future ?

Yes we will have better cpu/gpu and other tech, but there will be a big restriction on smartphone aesthetic design, people will be forced to get an apple IOS .... it's sickening >->;

So this means future samsung and other non apple smartphones will need to revert back to the ugly outdated style ?

If you think about it, how else would a smartphone look like. touch screen base is the way to go. so that part would obviously be flat and cover as much surface size as possible.

then the shape of the phone would be thin and rectangular in shape. The edges may either be boxy or rounded.

but apple doesn't like competition so they are making ridiculous claims by patenting the rectangular design on smartphones to block any competition.

First to patent rectangle wins

QUOTE
The jury validated almost all of Apple’s claims against Samsung, for many different smartphones and tablets, putting the South Korean electronics giant on the hook for $1.051 billion. The jury also found that at least some of the infringement was “willful,” which helped lead to the high figure. (Take a look at the complete verdict form here.)

Among the Apple-patented features Samsung devices were found to have been infringing upon: the “bounce-back” that happens when you scroll to the end of a list, double-tap zoom, pinch-to-zoom as well as the design and iconography on iPhones, iPads and iPod Touches.

The Samsung devices affected include the Galaxy S, Galaxy S II, Mesmerize, Vibrant, Fascinate, Skyrocket, Epic 4G Touch, Droid Charge and Nexus S smartphones and the Galaxy Tab and Tab 10.1 tablets. It’s not known what the fate of the infringing products will be yet.

Added on August 25, 2012, 8:30 amFor the iconography you can see why they would say they copied them.

E.g. the sunflower. Why did samsung have to use a sunflower like apple did to indicate a gallery ? their rendering of it was different, but when lots of the images e.g. gallery, contacts, mail etc are just remixes, there is a consistency of copying the idea of the set of icons used in apple products but now in samsung albeit remixes of them.

So on that point i can agree they were copying the idea somewhat, but i don't see how that justifies a 1 billion dollar fine o.o;

because after all, apple does not have a patent on sunflower used in art do they ?

The proper term for this iconography copyright is referred to as trade dressing.
QUOTE
United States

In the U.S., like trademarks, a product’s trade dress is legally protected by the Lanham Act, the federal statute which regulates trademarks and trade dress.[2] Trade dress protection is intended to protect consumers from packaging or appearance of products that are designed to imitate other products; to prevent a consumer from buying one product under the belief that it is another.[3] For example, the shape, color, and arrangement of the materials of a children's line of clothing can be protectable trade dress (though, the design of the garments themselves is not protected),[4] as can the design of a magazine cover,[5] the appearance and décor of a chain of Mexican-style restaurants,[6] and a method of displaying wine bottles in a wine shop.[7]

pinch to zoom is a very useful feature, and is what makes navigating the web on the smartphone so easy. not only that, i use it to view pictures, and read my manga. so what will happen for Samsung Galaxy S3 which has this feature ? Will it be stripped away in a future firmware update ? Does anyone know shocking.gif ?

Samsung Galaxy S3 germany model ill have LTE4g with quad core.
http://www.androidauthority.com/samsung-ga...germany-110192/

The reason The S3 didn't have lte4g with quad core was because we were told they don't work well together. But they may have some how got past that obstable apparently.

Other then having LTE4g with Quad core exynos cpu, it will very likely sport an extra 1gb ram = 2gb total.

So this German model may be better than the South korean one at this rate doh.gif but expensive like crazy.

Does anyone know if LTE4g works with Malaysia's wimax service ?

Appeals And Consequences
As for the whole appeals thing? Don't let anyone tell you that "the verdict doesn't matter." They're wrong. The verdict matters hugely. The jury decided that Samsung infringed and diluted, and those are findings of fact. An appeals court cannot overturn findings of fact unless "no reasonable jury" could have arrived at those conclusions. I'll tell you right now: that's not going to happen (it is exceedingly rare).

The insanity o.o; if you ask me, that is way too broad to claim rights over... and pretty much corners the entire smartphone market shocking.gif

Suffice to say, Samsung's appeals docket will probably be pretty long. How much good will it do? Just know that the 9th Circuit Court of Appeals has a little over 10% rate of overturning district court decisions. Better than some circuits, but it doesn't take a genius to see those aren't good odds.

Considering the parties haven't settled by now (and Samsung won on zero counts), it's unlikely Apple will be interested in compromising in exchange for Samsung foregoing an appeal. At this point, they're in it to hurt Samsung, as they've made clear.

So, what can Samsung do? For one, it needs to remove all the infringing software functions from its phones claimed in Apple's software patents. Second, it probably needs to evaluate the future of its TouchWiz UI, and the design of its phones in general.

That is bad news for consumers. Apple couldn't fight Samsung in the real market so they fight in courtroom.

I hope future updates to S3 will not remove features like pinch to zoom, unified search etc

i too was interested to know if that was the case.

anyway i updated my post above with quotes and screenshot of what exactly samsung was found guilty of infringing on.

a lot of it is alarming, but for S3 users the software bit is probably whats going to affect us, such as pinch to zoom shocking.gif

One fingered scrolling .... this is important sad.gif ...

I did not see any mention of global search.

It doesnt matter to me either samsung or apple win at court as we know the genetic winner of the court is always the wealthier side.
consumer will know which devices have much better offering such as display hd,ability of multitask running,etc...
Perhaps the ruling of retangular shape could b spark on tyre industry?all same round rubber tyre shape.dunlop,goodyear,bridgestone,etc....

Can a second hand buyer call any samsung number to check warranty? I thought you can only sms, and customer service don't entertain calls asking to check warranty.

you know what .... that thought in regards to tyres analogy crossed my mind just before you said that thumbup.gif

for the life of me i am not sure how smartphone designs can be anything else than a rectangle with rounded corners , with a flat front face lcd screen, covering a significant portion of the phone size hmm.gif

this is way beyond an a debate of innovation, as it's more to do with common sense sweat.gif

It's like saying why not make wheels rectangles to be innovative, as that is clearly a different design laugh.gif

Most likely a separate LTE modem placed inside instead of an integrated one in the S4.

Though I believe WiMAX and LTE are non compatible since Sprint shifted their 4G service from WiMAX to LTE and their old WiMAX equipped phones aren't usable on the new network.

Think they had a stronger case against the older products. The designs of the newer products aren't so similar that it can be said they are obvious copies. sweat.gif

ah thx for the explanation. didn't know they could do it that way. maybe they didn't before was because the cost would too high hmm.gif

but now they see people want it, so they're going ahead thumbup.gif
