 Can GYM sue a person, Send lawyer letter and take you to CITOS

Hi All,

Can i ask u guys can a GYM sue you or take to CITOS for signing agreement for 1 year and paying up their monthly membership.

Fyi,i was very angry with Celebrity Fitness Kepong....every time i go club is full.... so i decided to quit...the club is too small and many members.

depends on the finelines written in the document but they probably won't it will costs them too much money and too much time to sue you.

You signed an agreement for one year. You legally agreed to pay membership for 1 year.
Regardless of the reason, if you stop before the agreement is over you are still contractually bound to pay the stipulated amount.

You can try to ask for transfer to another club. Maybe drive a little bit to 1U?

but the opportunity costs is high when the use their time to sue one out of many customers just bcuz of this. and yes, you will still have to pay or if they have a clause such as if u break the contract agreement. the deposit u paid will not be given back or something similar.

If you break the rules of the agreement and refuse to pay, they have the option of legal action. It doesn't matter if the lawyer is cheap or not, in a lawsuit YOU will be charged for their lawyer fees on top of the disputed amount.

well i have to add here...you know that they gym is small...it is celebrity fitness express...not the full gym..
so confirm full one. that is 1 reason why i never signup.

well most likely these people will avoid this confrontation. They will allow you to transfer to another gym one.
Go talk to them and see what they say. get it in written wat you are proposing to them. get them to stamp acknowledge received.
then when they want to sue u, you have evidence that you have tried to negotiate a resolution in which they refuse to agree upon. case won.

Let's look at both sides of the equation.

1) One signs a legal agreement so one is obliged to pay.

2) One signs up for a product/service where "every time you go, it is full". That could mean a non-fulfillment of contract and non-delivery of service as per the agreement.

I'm no lawyer, but one can make it clear that one wants all the facts to go very public about why one is unhappy about the product/service offered, as a defence, if one gets sued. Also mention that you would want to make it very public so that everybody knows that if you sign up with them and then change your mind, they will sue you.

Whether they want to go ahead and sue, well, it's up to them.

Dear TS,

Yes they can sue you for it.

Sometimes they enggage lawyers for their debt recovery in bulk cases to there is a slim possibility that they will do so.

dont worry much about costs as the amount of costs awarded in the subordinate courts are fixed.

They cant take a bankruptcy proceedings against you before they get judgment and even after that, the debt must be more then RM30,000. smile.gif
