QUOTE(60minute @ Jun 7 2010, 10:04 PM) can they just cut my salary? since it is not my fault of getting overpaid, plus this company is MNC company from Japan. This is when your honesty is being tested. If you insist of NOT PAYING after they ask you to, you have foolishly gamble your reputation away. Continue staying in the firm won't get your anywhere. And resigning gracefully (now/future) still leaves a black mark in your resume. I can't believe such topic are started. You're NOT a little boy anymore, need to be sounded only then "reluctantly" give up. yeah. Why CAN'T you pay them back instead of having them forcefully takes a cut from your future salary ? The only main reason would be you have spent what you earned (or over-earned). Even WITHOUT letting your firm know (its right or wrong ) , they will assume you're someone who is not good with $$$, which yet again another big blow to your credibility ,affecting your chances in get promoted next time.

So, you passively counter-rob them. OK. Wish you all the best... Wait, I mean, wish your company all the best.

Lol. What a question. Yourself can even answer then in 60 seconds.
You have no obligation to pay them back, but you also have no obligation to ask for a promotion/increment in years to come.
Your choice.

Ask them to deduct the necessary amount gradually from your future salary. If they overpaid you 100 per month for 6 months, then they should deduct 100 per month for 6 months.
You shouldn't try to keep the 600 bucks, but the company should not ask you to compromise your existing cash balances by correcting in 1 day an error they took 6 months to do.

Honesty is the issue here I guess.. While you are under no obligation to return, it will affect your reputation heavily. The company won't trust you to manage anything involve money etc.. Since it's a few hundred only, why risk your reputation?

He put it into your pocket himself, walked away, forgot about it and then comes back a few months later, says you owe him 50 cents and he wants it back right now.

I don't understand why this is even a question. Give back what is not yours. Sure the agreement sucks but it is an AGREEment (you AGREEd).
If you don't agree then no Agreement no job. Go find job elsewhere if you not satisfy. Many fish in the sea.

don't treat him/her that harsh. examine what 60min's trying to say, that the company promised to give 100 petrol allowance but later in fact nonsense, company gives nothing, and "hence, i don't want to give back the money because i feel like they want to rob everything from me.", maybe the company also trying to get back money more than what are they supposed to get.
and he/she has been working for months, so few hundred bucks maybe equal or lesser than total allowances (100/month) 60min should get.
my opinion, if u can get new job, better u move,, why bother to work to company which such unprofessional behavior,, if not and you think u can survive there, i think u should give it back.

Do i under any obligation to pay back the overpaid salary? Please help me~ Easy. Look back at your employment contract. How much did they say they pay you? If they overpay you, means you have to give them back cause it clearly a "glitch". If you try to bring this to court, they will still win cause it's stated in the contract. Also for employer relation sake, I suggest you to pay it back or you will face future problem even with new company if they get hold of the news. Now that person A found $$$$$$ in his/her account, took it and ran away overseas hoping they cannot trace him/her there. Unfortunately bank call interpol and he/she was caught and put in jail. Well, no one ask the guy/lady to put extra "0", but person A still goes to jail regardless for stealing. This post has been edited by MinusGear: Jun 8 2010, 02:13 PM

It's never a bad thing to pay back.
You could also highlight to them about the allowance and because they owe you 'x' amount of allowance, you felt that there was no need to refund or pay back due to outstanding allowance that was promised.
Just ensure that your contract did state the allowance and amounting to how much per months (without special terms and conditions applied). If they insist you refund and yet not provide you your allowance, you can bring this to court in which I'm not sure if its worth your time and money because you will be looking for a new job if you went this far.

Yes, you should pay back. Well, my company actually includes this situation in the code of conduct/ethics, any overpaid by the company should take the initiative to report to supervisor and return the exceed payment.
IMO, you should.
