Viruses have hit PCs, phones. But I can't say for sure a virus would be created for such a console. But it would be true that only through a secure channel (or actually, through SD cards also) that it is possible for the bypass of the security.

There's a big difference between modding your console (giving permissions to alter the system), and unintentionally infect the OS with rogue programs (entering system without user intervention.
And who would want to put viruses in their own console with SD cards?

Just by passing by us, they can read or extract our information.
Don't forget that wireless communications between DSes are encrypted. And even before any critical informations are exchanged there'll be some sort of "handshake" between the the DSes to determine the identity of the device as well as the software.
The reason piracy for DS exist because they found a way to completely bypass security check, however the security itself remains intact (not cracked). There's no easy way to do the same thing for wireless communications.
As for your personal infomation, it's Nintendo you're talking about. Of course that will be privacy measures, I just hope that it's not as troublesome as the FC system. :/
