your phone is actually is network locked..where did get the phone..??? normally if US set activate the phone wit a US sim then jailbreak and unlock it...you a use the phone already...

Yes you can..to go up you can shift restore but once you are 4.0.1...you can't go down to 3.1.3...incase you have jailbreak and catch the shah file...
