Hi, not sure should I ask in this thread or not. If not please kindly advise.
This is my issue:-

Now my dad is having a credit card debt with bank. But currently he's unable to do the repayment due to he got stroke in last Dec. I've just received a call from something call jabatan kewangan saying that they want to lelong the house currently I'm staying because back in the pass my dad was using this address to register all his loan and credit card. The house is not under his name. So,I would like to know do they have the rights to do this? And I would like to ask do they have the right to ask us help my dad to do the repayment?

To make things simple I just assume the fellow who called you is the rightful creditor.  If your father doesn't have ownership to this house that you stay and you (and other owners) of this house do not give any guarantee to your father's debt, then the creditor has no right to foreclose your house.

Thanks for your info. But how if previously when my dad is applying for the loan or credit card he has the ownership of the house? Now he doesn't.
The fellow who call me was saying that she's doing the filling for my dad case to be submitted to the court.
She has given me the contact number to contact with. But I would like to collect some info before I call the in-charge person. blush.gif

Unless the property is charged to the financier, it is not an issue whether at that time your dad owns the property or not.  Your property is not charged to the financier as collateral, right?

As I know it's not charged to the financier as collateral. Once again thank you for your time.
I will talk to person in-charge and hopefully it can be resolve as soon as possible. sweat.gif sweat.gif

ownership can be changed before one knows he gonna bankrupt

problem here is bank can pursue if ownership change took place within 6 months - 1 year period

How if the ownership changed more than 1 year period?

then he is safe even creditors file for bankruptcy and judgement delivered

Ok. Because this morning the phone call was informing me that they are going to submit my dad file to the highest court and want to foreclose my house.
So I'm not sure whether if they submitted the file, will my house be foreclosed. sweat.gif sweat.gif
