well, for me..i don't really can see that TS made an appointment with u to trade with the TV. Sorry if i got it wrong, but your post is kinda messy and im a bit lazy to figure out what is what. And you didn't reserve the TV with any deposit either. Unless u have made a deposit, i don't see the point of arguing. The seller has every right to change his mind unless a reservation or deposit is done and confirmed by both party (that what i do usually). Juz my two cent.

i did ask about the tv ,rt.?u reply me bst price rm400.rt?but when i turn up there in ur condo ,we already agreed that i will pay rm50 for tv which u sell rm380 to me since i also taking ur partly faulty washer ,rt.?and u even wrote a small voucher stated i pay rm50 deposit for the tv and will come back to take it on 27 june ,i put the money rm130 on ur table while u written the voucher ,rt.? but when only i go check ur air cond compressor at the back of condo,out of sudden u and ur japanese friend said theres some one sms to come to view tv ,then later u even broke ur promise not to sell the tv but only the washer by claiming u promised to let the on coming person to view it first,and suggested i bid for the tv ,see who can giv higher price to buy it,i wont forget so fast ,will u both so forgetful??
if u r in my shoes ,take all trouble sms and ask thru phone calls ,checking thru the guard house and waited for so long but atlast get back home empty handed ,wat will u feel?u shouldn`t put 1st come 1st served since u dun follow the rules . vmad.gif

Let's talk this in Contract law's issue to bring things clear..

Firstly, in order for a contract to be valid, you will need to see whether it's an offer or an ITT
if it's offer the elements below
which will be either OFFER>>ACCEPTANCE>>CONTRACT or OFFER>>COUNTER OFFER>>ACCEPTANCE>>CONTRACT
I stated clearly at my threat that, I am selling those things with 50% of deposit as reservation to my items and collect from collection date..
You offered me RM50 as deposit for the TV instead I asked for 50% which means rm200, In this situation, you given me a COUNTER OFFER, which means that
once Counter Offer took place, the original Offer by me is void. It's depending on whether I am willing to accept your counter offer or not, ON THE FACTS,
Last night I did not accept it and said I can't confirm you
, you are the one who can't bring thing on negotiation and keep on forcing me to sell you.

I told you that, there are another people who coming to see the TV therefore I can't confirm to you, because this guy has been asking me since long to see the TV but i were not free to show him before. You started to tell me about those first come first served, I understood that first come first serve, but as a fairness to other people. I could not just sell you the TV while I have another buyer who is in appointment with me who already reached my premises to view it
in order for the "FIRST COME FIRST SERVE" to take place, We must have everythings agreed in order for me to take my words of first come first serve, if everyone using this words and approach me. Even "sumbat" me with RM10 for my TV, then it means that I have to sell? If I dont sell means I breached my words to them also?
as u mentioned me as a CON MAN, I didn't want to be a CON MAN and thus, will I be that idiot of making appointment to 2 person who are interested in the same thing to come together? How am I going to face another person if the early comer came and bought?
even the first come first serve is here, but it won't be good for me to do that as well..

furthermore, I were not aware of you are comming for the TV, as in our sms-es, we were talking about the washing machine. No negotitation about the TV hence can you say 100% my fault also. In the msg from LYN, you didn't tell me if you are accepting my offer of RM400 or not also. If I aware of it, how can I know you if you are comming for it or not?

I keep on talking to you, and hope for your understanding about my situation, but u didn't take my words in mind and keep on forcing me to sell u using that FCFS word

You given me a counter offer of giving me RM50 as deposit, I did not accept it = no contract
if there's no contract between us, how can I breach[first come first serve] it?

In short, there are no contract between us, but you are messing around by calling me as con man,
under the law of tort's defamation, you had been talking some untrue statement to spoil my reputation.
Even under Section 1 of the Defamation Act 1984, apology could not be a defence, then may I know how can I claim back my spoilt reputation from you?

p/s: when is the moment that I agreed of your RM50 of deposit? you throw the money on the table, i didn't receive it by my hand, in this situation, how can it be i accept your offer?
if this is mean by acceptance, can I just put RM10 on your vehicle's windscreen and say I am going to buy your vehicle? NO right? You keep on forcing me to sell you the TV, in this situation, what can I do ler? I'm almost blank, the original buyer which waiting me at downstairs for guidance to my premises is waiting there but you are keep talking about the "FCFS"

If you want evidence by that appointment is not last minute's sms, I can ask that buyer to mail moderator as evidence and show moderator of his enquiry mail as well. This can prove that I am NOT trying to offer "the higher get the item"

What I can say is NO, I stated clearly there that the washing machine does have the faulty part. It's your own willing to accept it with my offer.

what you said is correct about contract law....what i said about consideration is also part of contact law....the part about first come first serve basis is also bullcrap....you have the right to sell to the highest buyer not sell to the first buyer sweat.gif

yep, I understood that I have my wrong but it's just not that because I refuse to sell him, as I mentioned, I have not confirm the deal with him, then how can I breach my words ler?
I can say my negligent part is failure to find that both inquiry are from same person. He didn't tell me if he want it or not, and there's another person who got an appointment with me earlier...Then what do you think if the person who coming to see it, arrived but the thing is sold? I would not asking 2 person to see same thing at once if he did confirm with me about what he is interested in, as mentioned, in sms, we were not talking about the TV at all...

In your example, the item is FREE for grab and it's for first come first serve.
what if it's talking about money? If he come first, but I don't agree of the terms also I have to sell just because of he is the early comer? Don't talk about the third party here, let's talk about his deposit. I requested for 50% of deposit but he is offering me just RM50 which is not sufficient to my 50%. Then I also MUST sell cuz of he is the early comer??
