Paul Yong only got Hisham Teh at the final stage, but by then it was already too late.

A lot of people make this mistake as thinking that saving the best lawyer for the appeal will help. But the truth is, you need your best or at least an experienced lawyer right from the first court.

If things go wrong there, it's hard to fix later. Appeal judges often say they won’t interfere with the trial judge’s assessment of witness credibility. Unless you get a really good appeal judge like in the Joe Mamak molest case, it’s tough to turn things around.

But you will be suprised mostly on appeal your conviction will be overturned if the counsel knows how to argue on the main point. Just concentrate on one/two point more than suffice

Most people don’t have a law degree, so they don’t understand the legal consequences. They also don’t realize how bad things can get with appeal judges. A lot of judgments say appeal courts won’t interfere with the trial judge’s assessment of witness credibility and that’s a huge problem.

The worst part? High Court judges don’t even need to explain why they reject an appeal. They only write a 'Grounds of Judgment' if the Court of Appeal grants leave to appeal. And even then, they only answer the specific question approved as they can completely ignore whether the elements of the offence were actually proven.

That’s just wrong.

Parliament really needs to fix this. High Court judges should be required to give proper reasoning when rejecting an appeal. It’s too important to leave it vague. mad.gif

Why blame the accused and not the lawyer? The trial judge said the police report was an afterthought during the defense stage but come on, the lawyer didn’t even question the witness about it during the prosecution stage. Then the judge turns around and says the defense is weak.

And what about the IC? It was lost long ago. How can that be called an afterthought? The lawyer should’ve grilled the witness ask why the police didn’t get the CCTV footage, why they didn’t trace the phone number registration, or call the 7 Eleven staff to testify. That’s basic stuff. An experienced lawyer would’ve easily poked holes in the case.

So here’s my advice, if you can afford it, get the best lawyer you can for the trial. At the very least, make sure they’re experienced. Don’t wait until the appeal stage as it’s usually too late by then.

He complained the ambulance too slow, but he left the hotel before the body discover. Why he didn't stay at the hotel waiting for ambulance.
Due to ASEAN summit, the police stopped him and went up only discover the body.
