Security guards have no authority to demand, scan MyKad - NRD

PUTRAJAYA: Security guards do not have the authority or right to request, hold or scan the identity card (MyKad) of the public, according to the National Registration Department (NRD).

NRD in a statement to Bernama said only five categories of officers are allowed to do so under Regulation 7(1), National Registration Regulations 1990, namely NRD officers, police officers, customs officers, military personnel on duty, as well as civil servants authorised by the Director General of National Registration.

"Any action by security guards to request or keep identity cards is against the law and action can be taken," it said.

The NRD also stressed that the use of electronic devices to scan MyKad data is also not allowed, as it is subject to provisions under the Personal Data Protection Act 2010.

"Any processing of personal data by private parties is subject to the Personal Data Protection Act 2010, which sets out guidelines and obligations to protect individual personal information," according to the NRD.

Bernama contacted NRD to seek clarification on the issue, following a recent viral post on social media about a security guard at a premises who allegedly used an electronic device to scan MyKad.

The security guard's action has sparked questions from the public about its legal validity.

As a security measure, NRD advises the public not to hand over their identity cards to any unauthorised individual and to report any violations to the relevant authorities immediately.

and usually they only hold it....now they're scanning it?...who purchased the machine...ask that person

Not under Regulation 7(1) of the National Registration Regulations 1990, that says only:
NRD officers
police officers
customs officers
military personnel on duty
civil servants authorised by the Director General of National Registration

Housing Management don't fall under the categories that are allowed to hold/check MyKads.

Banks are authorised under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001

Technically it doesn't have to be the MyKad: it can be passport, birth certificate, driver’s licence, "or any other official or private document as well as other identifying information relating to that person"

(Foreigners can open bank accounts in Malaysia; but they don't have MyKad's)

But I suspect for frontline bank staff they wouldn't process a Malaysian citizen without anything less than a MyKad.

Lesen memandu boleh. Jangan bagi IC, tapi lesen mesti dikembalikan lepas check.

then guard will just say no ic no entry.

then you voluntary give the ic to enter.

Hotel is different must either IC or passport. I think there is some requirements guidelines under the law need to follow to keep in the system. Security guard no such law in place to have you show IC because they can also be a foreigner. You want to give your IC to foreigner?

some of them even scan front and back mykad to other visitors. I confront the guard asking why u do like that ( I gave him my driving license anyway ) , he said the management ask us to do liddat

that mykad digital copy can be misused in so many ways, and yet we are so surprised how come scammers can get our details and all that

true but at the same time many condos are about to ban outsiders from entering
it will also saves them a lot of money

hotel is required by government to ask for your IC
they will have to either scan it or photocopy it
they also need that IC to verify if you're malaysians...if foreigners, have extra tourism charge
