SEPANG: The sessions court here has fined an odd-job worker RM3,000, in default six months’ jail, after he pleaded guilty to posting a lewd comment about the infant daughter of clinical specialist Dr Amalina Che Bakri on Facebook in December 2022.
Judge Ahmad Fuad Othman handed down the sentence after hearing mitigation from the accused, Ahmad Nasir Kadiri, 57, and the prosecution’s submissions listing aggravating factors that warrant heavier punishment.

The charge was framed under Section 233(1)(a) of the Communications and Multimedia Act (CMA) 1998, which carries a maximum fine of RM50,000, or up to one year imprisonment, or both, upon conviction.

Nasir had sought a lenient sentence, citing financial struggles, poor health and remorse for his actions.

He told the court he was bankrupt and earned a living by harvesting oil palm and collecting scrap metal.

He told the court he was bankrupt and earned a living by harvesting oil palm and collecting scrap metal.

“I plead guilty and appeal for the lowest possible sentence as I am poor and have no fixed income.

“Next month, I am scheduled to undergo a knee operation and I rely on daily medication for high blood pressure.

“This is my first offence and I promise not to repeat it,” he said, sobbing.

Deputy public prosecutor Fadhli Ab Wahab urged the court to impose a deterrent sentence to serve as a warning to the accused and the public against the misuse of social media for making lewd remarks.

According to the facts of the case, the accused posted the offensive comment using his Facebook account “Bro Nasir” on Dec 15, 2022.

Amalina, a surgeon based in the United Kingdom, lodged a report with the Malaysian Communications and Multimedia Commission (MCMC) eight days later.

Authorities later raided the accused’s home in Kampung Bukit Changgang, Banting, Selangor, seizing his phone along with two SIM cards.

Earlier, the court stood down briefly after the accused complained of a headache when the charge was read to him.

He was seen using an inhaler and rubbing his chest before informing the court he was fit to proceed with the hearing.
