KUALA LUMPUR: A 32-year-old man was sentenced to 30 days in prison by the magistrates’ court today after pleading guilty to reckless driving.
K Darmaraju was charged under Section 42(1) of the Road Transport Act 1987 after sideswiping a motorcycle carrying a middle-aged couple on the PLUS Highway last Saturday.
He was also fined RM12,000.
Magistrate Khairunnisak Hassni ordered Darmaraju to serve six months in prison if he did not pay the fine.
depending on how the Investigation officer write the report....if no element of criminal found, driver plead guilty then nothing the judge can do what...
honestly the sentence is pretty low. So if I bang and then ask someone to admit for me saying they loan my car, thats roughly the sentence they will be getting.
It was reported that a motorcyclist and his wife were injured after being thrown off their motorcycle when a pickup truck struck them on the North-South Expressway, an incident that has since gone viral on social media.
You can always say “I heard a sound and I thought he hit me.” Besides, many people amend reports always.
I’m just clueless why he got away so easily. Thats why I said, mob justice for these kind if cases is better. The law always looks at an accident as “unintentional”.

Did the judge/panels even see the videos?! Racing in a piece of shit 4x4 that is NOT build for any sort of driving nor high speed braking by itself should already be an attempted murder.
Regardless of the potential appeal by the prosecutor, it's still baffling how low the initial punishment was dished out, taking into consideration *alleged* records of him giving fake reports, huge public interest-dissatisfaction, and the damage caused to victims
If this is not handled properly, i have a bad feeling about what comes next. This could just spell another round of low confidence in judicial rulings (though it's justified in papers, it does not represent the public sentiments, therefore the conflicts, and trust deficit in the law), it usually results in ugly altercations. Next time any accidents happen, public might act out of rashness and lash out at the potential offenders before they get a 'saving chance' from the law.
Have we not learned from the temple issues that brewed into all out hatred in fagbook and deeply entrenched into the minds of the public everytime they sees a temple by the roadside.

That’s the e problem with our laws. An accident is an accident even if it is due to reckless driving. I think its best to bring a civil case against the driver.

Again, I'm talking about expenses incurred by the hospital treating the 2. Fine goes to gomen because gomen is the prosecutor, but public hospital subsidized by gomen.
DPP can re-charge to involuntary manslaughter if the victim dies later.
And after reading further in Malaysia, double jeopardy can also happen if the higher courts overrule the lower courts. Since this is magistrate court, yeah law still have still a ways to go.

The driver involved is unemployed/working freelance according to the pickup owner so there's hardly anything to look forward to. Best bet is to go after the vehicle owner himself but that's gonna be a long arduous journey not everyone can stomach.

Imo, there should be an overhaul with the system to stop loopholes like this from preventing a case from being heard in court. All cases especially ones involving the lives of others should go to trial so that punishment meted out fits the crime.
Also, we should have a similar law to muricans, whereby a gun owner could be held accountable if their weapon is misused. Here, maybe charge the vehicle owner too if their vehicle is being misused by another party. Heck, even lyn does the same by penalising the person whose invite code was being misused.

If the victim doesn't know of anyone, I can help. However I remember reading an article in which the victims daughter mentioned that she would leave it to the police instead.

Getting lawyer to go against developer is a nightmare already and this case appears like it's been a setup, so whether the any lawyer is willing to be engage is another thing. Someone who is willing to go against the grain would surely help. What is lacking now is eyewitness to this case. No doubt the 4x4 can't be stopped but if someone had actually tailed the 4x4 from the time of the accident, surely this would be interesting as hell if the eyewitness accounts differs completely on what's recorded by the court

Punishment is to keep pipit in range so they don’t riot or what not.
